The neighbor himself pointed out two reference points on the property line before the container was delivered. A easy thing to do would be to sight down and see how far off it was.
And for some of you I am a bad neighbor. I am the kind of guy who would check twice or even three times to be sure what I did on the property line was ON MY SIDE AND NOT THE NEIGHBORS. I would also be the one who if unsure would either talk with the neighbor to be sure or have it surveyed befor I wound up on my good neibors land.. And yes it did take a long time to get to the container because we are still trying to work out previous issues as well.
so I am the bad neighbor who ordered the survey to have proof of where the property line is. A good neighbor wouldnt have put me in this position to begin with.

I never thought of you as a bad neighbor. But I don't believe you can collect the cost of a survey.

Q- was your purchased survey only focused on the immediate area of the container? Or did it survey your entire property, including property lines far away from the disputed item?

When I put our fence up for our goats I *thought* I knew where the property line was. 5 years later the neighbor has the land beside us surveyed and part of our fence was on them. She came to us and showed us and within a week I had the fence moved 3 inches off the line to our side. No fussing, just good communication. When I added onto the fence on the back side I approached that neighbor with my intent. He came and met me one day and we found all the stakes where he had it surveyed years ago. The fence is 2 feet off that line so I can plant privacy bushes. Good neighbors communicate like adults, bitterness is like drinking poison and hoping the other person dies. It only hurts the one being bitter.

I've call a mehcanic's bluff a long time ago on a invoice I refused to pay.

I believe there is a difference between a laywer verbally telling you that you need to do something vs a certified letter from the same lawyer informing you what they are asking you do do. You should always follow up with any written letters IMO, particularly if they're sent "registered mail" and you signed for the letter.

I could be wrong, but that's my thought on it...

I refuse delivery of all certified and registered mail. You have a right to do that. Before I started doing that, I never once got a certified letter with anything good or beneficial in it.

An attorney can help with legal aspects, but I would expect a nice letter to start.

Per our previous discussions regarding property line of not knowing for sure where it is, I went ahead and had a survey done to make sure. The survey shows that your storage container is on my property and since I have not given any permission, please remove it promptly.

I think there are things you can do legally once the neighbor is notified.. If you don't address the issue now, it will forever be a problem, not just for you, but for selling the property. If the neighbor is running illegal BNB, report him.

If it was known that there was a dispute, and then there is an accidental fire, how could that be legally considered anything other than arson?

A friend just sold his place. It turns out that his nice and subtantial shop, (that he built without a permit) was sitting slightly on the neighbours property. He just razed the whole thing to the ground! No cost saving in that whole mess!

What are you talking about?? First, no one is suggesting anybody burn down anything. Second, arson isn't arson unless its arson. It's a fire of undermined origin until it's cause is proven. Otherwise, it's just speculation.

YES, someone suggested an accidental FIRE! I think if it was known there was a dispute, it would be looked at more closely. Who would even want to be suspected of such a thing?

First of all, I am not an attorney, but I slept with one last night.

My neighbor moved in last summer. Started a BNB managed lodge and now does not live on the property. We have had easement issues (previously discussed here) and not on the best of terms.
While he was here we discussed if he knew wjere the property line was. He pointed out what the previous showed him and that was in line with the county aerial drawing. The property a few years back was surveyed and market but all is overgrown.

Last summer he moved in a shipping container. It was placed on the property line but seemed to be on our side. I let it pass because of how long the easement issue has taken (still not finished on that either).
I called the survey company a couple months ago to locate the pins set on the line. Last week they finally had time. The shipping container is about 5 feet from the property line and on our side. That puts the container and a pile of wood about 30 feet into our property.

Won the battle of keeping the gate closed and locked with the easement user. But that can and will be a issue with all the BNB guests.
Seems like we both agree that a electric gate control with a pass code would be needed. Somehow he feels that that is all me to do.

Next step will be the maintenance.

What are the rules in your locale for abandoned property? Could you get the local law to post a notice on the container and give him 30 days to move it? Post a notice in the local paper?

My only concern here is that the OP doesn't seem to want to deal with any local authorities. He's been advised several times on both threads to find out if the neighbor is even allowed to do the rental thing as well as on other points regarding what who can do. I have yet to read that he's done any of that or what the responses were.
