If you follow free advice and it turns out badly, it becomes expensive advice. How many times have you been in a situation where you are working on a project or planning one, when you hear, "if it were me, I'd just, (fill in the blank).

Unless the person giving the advice has been asked for it, and has credible evidence of successful endeavors in the matter, I ignore free advice.

So it's been 2 weeks since your first post. did you hear back on the letter? I assume you sent a registered letter so you can prove he got it? I would look up the abandonment rules for your area. Usually you have to give notice and a certain amount of time, and then it's yours. I would tell him he has 2 weeks to make arrangements to move it, then sell it off. And you should file a police report and send a letter to the county. I know they don't really care, but you need to document that you tried to have him remove it and that he was notified.

If he would have just gone with the 5 acres from the coal company, he probably would have done OK.
Note to self: Don't try to steal land from the richest person in the county.

Actually some fella trying to steal land like he did, getting a smackdown, increases confidence (a little) in my own land ownership.
If Peyton was the one in the gov't back-office messing around he could have taken all of Stevens land.

Land ownership is a funny thing anyway, being just gov't records. That could all change.

This is a prudent first step.
Simple fence. Just a few T-posts and wire, on the property line, 3 inches on your side, in the vicinity of the container.
Don't spend money, don't bill for the fence, don't add needless and contentious layers.
It's not security, it's not a 30-year fence, it's "a notification".
And T-posts memorializing the survey markers of course.
Second step is a no trespassing sign on the fence near the container

This puts the neighbor on notice that he is trespassing.
Let him start the negotiations.
Send a registered letter that the container will be removed from your property in 30 days unless other arrangements are made. You could add that land rental negotiations must be agreed upon before the 30-days date. Don稚 put a fight in the letter. Just business.

Yep, he has the documentation supported by a survey so the next step is the simple fence. The guy knows he is using land not his. If you don't do something he can after five years petition the court for a quick claim deed to the property. The court is likely to grant the deed if the property owner has made no effort to block the offending parties free use of the land. The law may have changed but it would be wise to check your states requirements. Out west here the states i am familiar with require the land owner make an effort to block egress to his property. Close the road, put up no trespassing signs! ...chuckle....today its easy to install a camera or two to record violations of your property rights.

Just an aside, but that's a "quit claim"... which simply means the conveyor is surrendering all interest in the land. That's the type of deed which you would get if I sold you the Brooklyn Bridge. The OP is trying to determine the best way to ensure that what you describe doesn't happen. Unfortunately it sounds like his neighbor is the landowner from H***.

PS: selling you that bridge could backfire if I ever decided to visit NYC. While said bridge is indeed public property you would hold a deed showing that I relinquished any right to use it. :D
