You are certainly free not to avail yourself of the legal remedy for your problem and continue to confront the problem head on each time it arises.

It's not my problem. It's still ridiculous when we aren't able to defend ourselves in a court of law... yet still need to spend time and money to clear one's name.

But, do states' rights trump individual rights?

The Bill of Rights recognize certain individual rights...and certain state's rights. The states cannot legislate or limit freedom of speech, religion, freedom of the press...so, how can they interfere with the 2nd Amendment?

It isn't how, it's why. So that they can interfere with the first three which you mentioned, of course.

Joe...that was a rather inane post...

No state completely bans guns (although I'm sure many would do so, if they could). However, states like New Jersey, New York, California, and others create laws to harrass, discourage and make life very difficult for those who exercise their Constitutional rights (i.e 2nd Amenedment).
Those states have no power to do so, as that right, or power, isn't in the Bill of Rights, is it?

I was thinking the federal government couldn't force the states.

But 2nd amendment should be universal.

State law has to be within the bounds of federal law, or at least constitutional law. However politics stopped that years ago. It would take deep pockets to fund a court case to throw out some of the anti 2A laws. Too many judged rule by politics, and case law no longer reflect original cases or intent.

You proved my point Roy. You have the Federal government to thank for the fact that states can't ban guns.

Why isn't a M16 avaialable for the general public to buy?
Why isn't a M79 available for the general public to buy?
Why isn't a M60 available for the general public to buy?
Why isn't a TOW available for the general public to buy?

I'm not saying that some states don't have their head up their butts, but the line does have to be drawn somewhere and the feds have given that leeway to the states.

The bigger issue is the technology. One could argue that back in the 1700's, one man with guns could only kill the amount of people per the guns he carried. Now, one man can easily kill 50 people.
