Bottom line is JD should have never let engineer on witness stand.... JD's engineer screwed the case for them...

Yep. That lawyer made a fool out of him. And his testimony is completely inaccurate. Hard to fix that in the juries minds.

I did not want the tires loaded.
Dealer would not sell a tractor with fel and no rear ballast.

Running any equipment requires situational awareness ....ALWAYS.

The lawyer did his job and backed the witness skillfully in a corner.

This guy should have done his homework and understood what he was doing. Sad but preventable.

Dealers and manufacturers will add more warning labels and release forms to the sale process and move on.

Nope, they ain't doing that. As Tony said, they'll add more warnings. He forgot one important thing though. They'll add to the price as well.

All of us tractor buyers reading this thread will pay this settlement. Not Deere or the Dealer.

It won't just be the Deere buyers paying either.....all tractor makes will have to change policies.

It would never enter my mind to file a lawsuit over this. I would be embarrassed to face the court.

Such was the case when I bought my 2615. All tractors on his lot with a loader had ballast in the rear tires. My loader manual calls for it, too.

About the JD tractor in this case: The 3038e is light in the loafers at a mere 2175lbs. I had the opportunity to operate a friend's 3032e, which is the same weight. It was equipped with ag tires, unfilled. It was not a comforting experience, as the tractor felt very unstable in the conditions we were working in. In addition, it just lacked the necessary traction the owner needed.

It wasn't long before he had it back at the dealer, getting the tires filled. In addition, the rear wheels were spaced out to increase stability.

But I don't want my tired filled. But I do add ballast as needed, even back when I was a Newbie. There are plenty of lawyers for "stupid", but not enough labels for "stupid".


Beside.....3 point ballast is more effective than filled tires.....
