I'm not so sure it is all that appalling... I think the question is, who is responsible for educating the operator?
I think the question is quite the opposite. Where is the personal responsibility? Those days are gone apparently.

The operator should be responsible to educate himself with the information at hand. Maybe a hundred years ago a new cowboy should have been able to sue the guy that sold him the horse that bucked him off and broke his neck?

Not a child we are talking about here. Oh wait... maybe we do need nannies for adults? And we call this social progress?

The operator is responsible for educating himself. To do research and to ask questions. People are responsible for their own actions. What made him think he was educated enough to operate a tractor?. What would make him think he is educated enough to operate a firearm? Same thing.

I think I already made this comment, but worth repeating. If I tip my tractor over and hurt myself it would never enter my mind to sue someone...….

Let's say you buy a new tractor, check it all out, drive somewhere on your property, start going down a hill, it starts accelerating, you can't stop it, and it runs down the hill and hits a tree. No one is hurt, but the tractor is damaged badly.

Now let's say you investigate and find some linkage in the brakes had a cotter pin missing from the factory.

It says in your owner's manual to inspect the machine before each use, doesn't it? So that makes it your fault for not noticing the missing part from the factory, correct? Of course, you wouldn't claim the damage was the dealer or factory fault, because you didn't inspect the tractor first for missing or broken parts, and would eat the repair costs yourself, correct?


In the original story, the dealer was supposed to ballast the tractor for the loader that was installed, and apparently didn't. The tractor rolled over. They found something not correct that could have contributed to the roll over. So who's at fault, how much % at fault, etc... comes into play.

Of course, there was mention of the operator, seat belt usage, ROPS, etc... and that all comes into play as well.

How many of you have ever purchased a brand new car? I'm sure all of you got the keys and immediately opened the hood, and checked all the fluids, belts, hoses, tire inflation, tread depth, working lights, etc... before driving off in it, right? :rolleyes:

How can cars and trucks be sold where there is freezing rain or snow without snowflake branded tires? Is it the manufacturer or dealers duty to prevent all accidents? It seems there is a double standard here.

My dad runs his sprinter with oem all season tires, probably 200,000K on them, and the insurance company gives him a snow tire discount because he told them over the phone that they have a snow flake on them! Nothing ever seems clearly thought out.
