Exactly. Although there is a grey area there and really depends on state laws. If the nursing home sends them to the hospital for treatment, they are technically supposed to take them back.About as well thought out as a gov that filled nursing homes with COVID patients!!
There are exceptions, but those are usually limited to the ability to provide care. For example behavior issues may require a psych ward or lock down unit, or the patient requires something medical thats out of the scope of what the facility can provide.
Another exception is if the patient was actually discharged from the nursing facility to the hospital. Then the nursing facility is not required to take the patient back. But certain requirements need to be met for a discharge.
My wifes nursing home will except current patients back from the hospital if they are infected and were sent out for treatment. They also take care of their patients that contracted covid.
Any new patients are automatically isolated till they test negative twice for the virus. But they aren't taken care of by the nurses that are taken care of the covid patients.
