IMO if there are signs along the road that say 'Lots for Sale' and there are houses on three sides only a World Class AH (or entitled kid) would pretend 'nobody' owns the land and build a race track on it. I wasn't talking out in the boonies either but a pair of 20ac lots in the township bordering city limits on one side. (fenced lwns, etc)

Ask any kid that grew up in a subdivision:

The best place to play was the vacant lot. Unless there were signs that said keep out, it was usually the neighborhood playground. Once you were told to keep out, then you kept out and expected to get in trouble if you went in there.

When I was in college my brother and I cleaned up a vacant cul-de-sac lot in a subdivision; clearing the underbrush and carrying trash out. We also found an obviously fresh 6 pak of Michelob which my brother kept... as we were finishing up the teenaged son of the doctor who had hired us came poking around to see what we were doing. It was a nice gesture... the father paid us, the son bought us some liquid refreshment for that night.

We didn’t have empty or vacant lots. But - we had the school yard and the school field. That is where we would always gather and play. We all went to that school and never had any issues or problems being there day and night.

My father and a partner bought 20 acres and split it into 17 lots. On the partner's lot, the city ran a drainage pipe into the middle of one side and out the middle of the other side without consulting him. He sued the city, and they had to purchase the lot from him. It was unbuildable, with 8' drainage pipes entering and exiting it in an open ditch. That became our vacant lot. Great fun for several generations.

The area that the city was draining was two future subdivisions, a grade school, and the city airport! It was a lot of rainwater. The two subdivisions I watched being built as I grew up. Played in many vacant lots in those subdivisions. Also played in an abandoned county police shooting range. Abandoned gravel pits. A couple cemeteries. And the county farm/home property, which was a working farm. We ran all over that place and were never told to keep out.

I can honestly say that the only time we ever played on the school playground was at recess. No one played there after school. There were so many other great places.

Two points: 1) Most Texans are not rural. 2) I would bet most trespassers are not from the area they are trespassing. (my guess is a lot of them are city types who go out to hunt/shoot/cause mischief and don't care about fences, signs or paint)

The beauty of Texas is that you can protect your land if needed. I would still rather have them change the law to make posting unnecessary. I would guess very few landowners would be in favor of people being able to trespass. The current system would be like making a city post 'go lights' at every intersection. Go is the 'default' position. Most intersections are uncontrolled. "No Trespassing" should be the same default position.

Your two points:1) technically you may be correct but I think more rural land is owned by city dwellers than you realize. Im an example of a “urban area dweller” who owns rural properties. And where I live puts me in a very large urban MSA. I know one of the largest landowners in the US who lives in a Texas city.
2) Again superficially correct. And, really, how many thugs from the Fourth Ward in Houston (Or South Dallas) do you think go hunting and causing trouble up in NE Texas? Very few. The hunting they do in in their own backyards and neighborhoods and they are not the kind that are building tree stands on your little slice of heaven. They might set up a meth lab but they aren’t going to attract attention 4wheelin across your fields.

My experience is the trespassing we are talking about here mostly comes from Neighbors and people who live nearby and feel a connection to the property from past permissive use or ownership. Or they are the “new people” in the area who really don’t know what country manners are all about.

There is a very good point in there...I don't have to post 'no trespassing' or paint my curb purple in town...no trespassing is a given. There is simply no reason I can conceive for making rural property owners take the extra steps or risk liability claims. (or worse)

I get the sense you may be fairly new to owning rural property in Texas. Maybe you aren’t but a refresher might be helpful to cull available legal remedies from wishes.
