My ROPS on the BX is 1.5" too tall and I still managed to fit into the shed once with the ROPS up!

It was starting to rain and in my hurry to get it inside I forgot about the ROPS until my BX did a wheelie going under the header... talk about embarrassing!

Often thought how nice it would be to lower it 2" and never have to fold again...

I was requested to do it and I weighed in on the situation and felt the customer would be safer to have the ROPS cut and then left in the upright position than to leave it as it was and always have it folded down as he always used it before.

To the OP, your very lucky to live close to a man with such passion and skill work on your tractor.
All his work is first class, and with his care and knowledge, I,m sure your machine is now better than new.
He is one of the very few I would have no worries about working on my vehicles or equipment.

Another look at the ROPS and if shortened from the bottom portion, it looks like it would be just a matter of drilling some new bolt holes so no welding involved.

Good idea but in this case it couldn't have worked. The customer needed to have 9.25" removed from the ROPS. There wasn't a useable 9.25" on the lower section to cut plus I really wanted to keep the pivot points and pins in their OEM position and at their OEM height.

Exactly - that's why I had the BX transported out to Paul 100 km away rather than using a service about 10 km away.

That was exactly my point. A shortened ROPS that is used is much safer than a folded one which is of absolutely no value. Very few people are going lower it when shedding the tractor and then raise it for use. Folks here on TBN seem to think the ROPS is some magical material that should never even have a screw placed in it. It is just plain carbon steel tubing and I think many of them are designed way to high especially on these little SCUT frames. They should be able to go thru a standard height garage door without folding.

If you modify your own ROPS, then who is going to sue who. You couldn't very well sue yourself. Someone who modified an ROPS at the direction of the owner would only face limited liability for the work done should it break at the reworked area which is highly unlikely since even a bad weld is usually stronger than the steel it is welded to. I just don't see the lawsuit angle as being a reason not to modify and ROPS if it makes it usable vs not using it at all.
If your theory is correct, one could sue the manufacturer if you didn't use it and had a roll over because it was not raised due to garage door height. One might file a suit like that (as you say anyone can sue for any reason) but it wouldn't make it past the judge. Similar to not using a seat belt and suing the auto maker because you were injured in a crash, not going to happen.

This work was done in Canada. We don,t have ambulance chaser lawyers here, and we also have much smarter judges and jurys. LOL

I must fold my ROPS to get in the garage. If I'm doing certain jobs, I always fold it up, but there are times that it's just too much trouble and it stays down... admittedly, sometimes too lazy. So, I agree that a ROPS used, even if modified, is a good thing.

Now, I don't know this for fact, but I doubt that Canada is free of "ambulance chasing" lawyers ... Smarter judges and juries? I sure hope so, because they can't get much dumber than here!

That said, if a family sued because their breadwinner was killed in a rollover, the tractor inspected and found to have a modified ROPS, I believe a smart lawyer could relieve the manufacturer of any liability, and possibly place it on the individual that did the modification. We're not talking about common sense, which at one time reigned supreme, but legalese, which could take us anywhere!

Let me add that I appreciate 4 Shorts and his work. And I believe the ROPS he modified to be as strong as original, but, it's a funny world we live in!

Yup. One of the major differences between Canada and the US. In fact, the US is well known in many countries for how often people sue each other. And I'm just not sure why.
