cowboydoc, that is what the specification is for off-road. It can have as much as .5% sulfur. That doesn't mean it always does, but it can and still be sold legally as off-road. Since it costs money to remove sulfur from diesel, any on-road that has higher sulfur content than allowed (.5%sulfur>.05%) can be sold as off-road rather than scrapping it. As long as refineries and terminals (and suppliers) have the ability to store off-road separately, there is a chance you may be getting high sulfur fuel. Some people seem to prefer it.
FWIW, we're going to go through it again. The EPA is mandating that sulfur be reduced again, by 97% this time, from low sufur's 500ppm to 15ppm.
