I kinda like the "I spent the money" idea. She sent a credit card "check". I initially said (in my ebay listing) that I'd hold item 10 days pending check to clear... Knowing how excited she was to give this (ladies) necklace to her boyfriend, I even sent it out after the second day to try to help her out.)</font>

The credit card check is the only area where I see a problem. Can she call her credit card company and charge back a credit card "check"? I think you should find out the answer before you tell her anything, because quite frankly, if she can charge back the purchase, and you tell her "no", there's about a 100% chance you can kiss both the necklace AND the money goodbye. She sounds like one of those people who is dumb enough to do it too. If the check can be charged back, then you may want to negotiate the return of your necklace, and she pays the shipping back to you with insurance and signature confirmation, before you send off a refund. If she can charge back, and I was in your situation, I may even offer to pay shipping by setting up a label pickup with UPS or FedEx. The worst that happens in this scenario is that you eat the shipping cost and sell it on ebay again.

If she cannot charge back the credit card check (I would be suprised if she could not), I'd just email her and say (assuming it's true of course): "I'm sorry it hasn't fit correctly, but I did describe the size in the auction, so the size was clear before you purchased it. I'm not a retailer and I'm not in the position where I can give refunds. I'm sorry this hasn't worked out for you, but there is nothing I can do."

Interesting regards the CC "check". I assumed Richard had the cash in his pocket.

If she can charge back the 'check', then how long would she be able to do that? If there is a time limit, I would not respond to the e-mail at all, and wait for the time to pass. If unlimited time, and Richard doesn't have hard 'cash' in hand, I'd be real worried.

I will be real leary of accepting a CC "check" for anything as well.

Hope some more information comes to light here. I, for one, will be interested in knowing more. /forums/images/graemlins/wink.gif

Would the CC "check" be the ones that they send you to write out and charge you the "cash advance" interest?

I don't know about your country but here in OZ to do a charge back you must prove a breach in the deal eg advertised it incorrectly.

I would be firm if i thought i was honest, and say stiff s#%t mate.

I don't know the specifics, but on viewing the check, it seemed to be like one of the many they send to me (answering a probable yes to your question)

"consolidate your debts at X% for 6 months" kind of thing

Since I'm not a vendor, I presumed I'd have some arms length on the cc company. The check has been cashed. I don't see how the CC company can charge back my checking account??

I sent the above mentioned email and havn't heard anything back yet. I told the wife that if it does come down to us buying it back (which will be a last case scenario), I might offer her $350 to entice her to do something else with it. After all, it IS a $650 necklace that she got for $500 and was brand new, never worn. (wife won it as a prize at her work)

Now, having been worn by her fiance, it's been evidently used as a dog collar... /forums/images/graemlins/shocked.gif /forums/images/graemlins/grin.gif
