NO ONE should have to go through what you did. I can't imagine the extent of your anguish multiplied by the acts of that cad. You have the right to be skeptical of lawyers, but I assure you, we're not all that way. That's not the way I practice, nor do the vast majority of lawyers I know practice that way. In fact, a phone call to the local bar association would have probably dispatched that creep toot sweet. I just want to make my point that I shouldn't be painted with a broad brush. You have my condolensces, Billy. To you and your family.

Can you really blame lawyers, is it not the laws that are wrong. I don't think we are as quick to sue in Australia as you do in the US and I wonder if it is to do with the courts. Mind you we are probably catching up in a hurry. Sad /forums/images/graemlins/frown.gif

It has become the mentality of many of the American public to want to sue over anything. To try to place blame on someone, deserved or not, for their own personal gain or to try to push blame away from themselves. And there is always a lawyer ready. That is not to broad brush lawyers as such. In the yellow pages there are more listing for attorneys than probably any other single listing. Even a very small percentage of bad ones and the publicity that goes along with it are enough to give all a bad name. And yes. The laws, while trying to provide rights to the general public, actually encourage outrageous lawsuits.

If the misrepresentation caused problems (compressor blew up trying to work too hard, maybe causing injuries)........
YES, a suit might be in order.
If the misrepresentation caused no problems.....
NO, a lawsuit ends up costing all consumers. The company should be forced to correct the problem or face a fine.
Kinda like "no harm, no foul".

Filing a complaint with their Bar, won't change anything. I've been there, done that, bought the t-shirt and the video. The Bar is made up of _______________.

While I jump in on this a little late, please define for me the conditions at which HP is determined. At start up, a large electric motor like that found on most compressors draws in excess of 1000 amps for a fraction of a second. Under full load, under overload, or is a measure at the pump end in terms of air pump efficiency? Look at vacuum cleaners with "air watts". Car stereo amps with 600 watts RMS with unacceptablly high distortion levels. In all cases, it's a game to lead consumers to believe they are getting more. Buyer beware is still alive and well even with the government's attempts to get some uniformity. I am quite aware of most things I purchase. If a 6 hp compressor at Home Depot is selling for $249 and a 5HP Baldor 230V electric motor that is twice the size and more costs $300 to replace on my Delta Unisaw, I gotta figure something is up. For BillyP more heart goes out to you and I say, GOOD FOR YOU!

I got a letter from this the other day. They said I was "deemed to be entitled to a reward." I thought I already had been by filling in the website, but they asked that I filled out another paper and select my "award." I selected the rotary cutter and air hose. I believe they said it will be mailed out sometime next month, though I thought they were originally supposed to be mailed out in December. /forums/images/graemlins/confused.gif

Came home today and UPS was in the driveway, was confused as we hadn't ordered anything. /forums/images/graemlins/confused.gif When I saw where it came from - Devilbiss Air Power Company - I knew what it was. I had received my mini-rotary cutter, air hose, & blow nozzle. Hopefully some of you other guys will get yours before much longer.

Funny you mention this. We bought an upright 60 gallon Ch air compressor 2 ys ago.. and it just quit. The little thermal reciept on it is faded white.. and we are trying to have the credit card company research another receipt for us so we can make a warranty claim.. it has a 3 yr warranty.

Anyone have any ideas if the CC company can't come up with a reciept.

I have the old statement from 2ys ago that shows where/when we purchased it at TSC.. but just no reciept.

Now I see this class action thig.. hmm.

I know it's not much help to your particular problem, but I've started scanning my warranties, key reciepts, and owner's manuals, and saving them on the computer. That way, I have some hope of finding them. Not much, knowing my level of disorganization, but more than using my normal Black Jack Pershing filing system. "It's Over There."

Since last fall, I notice that there are a about 50-75 new CH air compressors at every local consignment auction sale that I attend (various sizes). I have bought 3 of the small pancake models at $20-$25 each "as is" and they work perfect and are new. I like that size for laying hardwood floors or running my brad nailers etc.--Looks like the MFg has liquidated a lot of these new products to wholesalers or flea market guys??--Ken Sweet
