I ran a excavation business for close to 10 years on my days off from the station. He should have never exceeded the estimate by more than an hour or two without consulting you. It is his misjudgement and he should eat extra time. I made a few of these when I first started but ate it and gave a quality job. I know in my state there is no taxes on labor. Now when I hauled in dirt had to add taxes. He should have stopped at 20 hours came and knocked on your door and explained what was up. If he has been working at it for a while sounds like he is padding the hours terribly. Any operator can normally look at a job and be within a couple hours to a half day. It is a matter of principal at this point. I would personally spend twice the diffrence on legal fees if it took that. In my book he is essentially trying to steal right out of your pocket......
