In the latest issue of Progressive Farmer there is a report of farmer who has had to spend $200,000 in legal fees to have a creamery on their dairy farm. The farmer went before some sort of board who at first supported his project. The board then sued him. AFTER the farmer had gotten a building permit and started construction.
The farmer thinks the reason the board started the various lawsuits is to preserve the view.
The board wants to make sure the farmer cannot use his land profitably so they can continue to enjoy the open space view. 
The farmer was just building a 10,000 foot building to make cheese, milk, butter, and ice cream....
