He knew it didn't look rite and used it anyway is the part I don't understand.



Supposedly, he did use it because he believed what the clerk at the store told him about it being OK. That's his story anyway. Looks like he's sticking to it.

entitlement mentality.. and as rick said.. no sense of personal responsibility.. ( coupled with lack of common sense.. If I poured a wrong looking oil into one of my babies.. i'd drain it right out and flush it.... I'll be darned if a 50$ pail of oil is going to ruin my multi-thousand dollar tractor.. even if i have to eat the 50$..

I actually have thought from the start that B2B brought a lot of this on himself because he wanted to try to prove a point about not being MADE to use OEM labled oil.

Sometimes if something is "recommended" to people they take it the wrong way and just want to let everyone know that they are not going to be TOLD what to do and how to do it.

if the oil looks different than what you are used to, then reguardless what the label said and the minimum wage day labor store clerk said.. it's probably the wrong oil!

Ok, there are a bazillion misconceptions in this thread.

1) MFG CANNOT require you to use their oil/filter. PERIOD. Oil has SAE/API ratings, if you match their ratings, you are good and they cannot refuse a warranty claim because of this. This is nothing new. ANY dealership that tells you that you must use their oil is lying and they know it. In Texas, this was required to be posted in the service department. Now, that does not mean that they have to sell another brand, or let you bring your brand. They also cannot require you to have service done at a dealership. 2) There are 2 parties at fault here. #1- The oil company IF the oil was mislabled. #2- The user who ran the tractor ANY after seeing that they were obviously 2 different fluids in the 2 pails.

3) "For use in Kubota" on the package means nothing. If the SAE/API ratings are the same as Kubota's specs are what means something. I have no idea what ratings (if any) Smittys oil has nor what the Kubota in question requires. If the oil does not list an SAE/API rating, probably safe to say that it doesn't meet the specs. At the end of the day, he will have to pay to get his tractor fixed. That's all there is too it. Too much has transpired since the incident, between the flush/change and usage, nobody will be able to say what was actually put in there with enough certainty to place blame.

If something like this happens, AS SOON as you realize something isn't right STOP and don't do anything else until you have talked to the relevant parties and sought legal advice as to what to do to preserve the evidence to establish what happened.

WVPOLECAT. Thank you for sharing the laws on this. On this I think we have to agree to disagree. You're pointing out here that BY LAW, we are only required to follow the SAE/API ratings and that anyone that suggests otherwise (to buy the tractor manufactured branded parts) is giving bad advise. MY POINT was to point out that BTB might not need to resort to the law to enforce his rights if he adhered to the tractor manufactor branded parts.

It might be smart to know the law and you're rights. But it could be wiser to not to need to enforce them in a lawsuit.

By buying the manufacturers branded lubricants and parts, even at a higher cost initially, can save you tons of money in legal fees, tons of time and effort in lawsuits, and lots of down time in a broken tractor waiting to be repaired. It helps to remove the question of liability in the minds of the dealer and manufacturer.

Moot point really... that 'branded' oil may have been accidentally packaged wrong on the filling line just like that aftermarket oil...

Bottom line.. if you are pouring a pail of oil into your tractor.. and it don't look like you know it should.. then STOP.

If you take a bit of food and it's rotten.. you spit it out.. you don't keep eating it!!

The plus side to using the OEM oils is even if they did package it wrong the OEM would be more willing to fix it then if it was a non OEM oil since it was their own oil that caused the problem.

Now, THAT's some SOUND advice. :D

Some people seem to be so hung up on a senseless point that "They can't MAKE me use their oil, fluid, etc".

Nobody is trying to MAKE them use anything. It's recommended.

Trying to force his point, I think, casued a lot of his troubles.

Well, if we are blowing this guy out of the water, I'll add to it. Do we know for sure he even grabbed the correct 5 gallon container. He says he did, but maybe he grabbed something else. I know someone that dumped glycerin(the kind you rub on chapped hands) in to a battery instead of distilled water. They were similar containers. I also know someone that dumped muratic acid in the gas tank of his John Deere mower instead of gas. I haven't figured that one out yet, but it happens. I find it hard to believe that they mispacked the oil, but it is possible.
