I don't see what carrying a loaded gun on the tractor has to do with game.

But I know game wardens can come on your property. One day some friends were at my place and we were firing some deer rifles on my on land, shooting into a target down in the creek bed 100 yards away. Game warden shows up and says he had a report we were shooting deer. We only have bow season in this county.

He thought it was pretty funny and after seeing that there was no way the shots could leave my property he wished us good fun and left.

Funny, I've never heard of deer so thick that you heard shooting about every minute for 30 minutes.

Two years ago, my son and some of his friends were shooting when 3 squad cars showed up. The deputies said that they were there in response to two 911 calls regarding a lot of gun fire. Of course this was in February, no leaves on trees and it is cold, so sound travels well. Found out who one of the people that called 911 were, and they live a half mile away. There is also a gun range across the river about two miles away, so I do not see what the fuss was about. The boys were only shooting a AK47, two AR15's, Colt 45 and a 357 Python.

The deputies did not do anything but check the ID's and take down the serial numbers of all the weapons.

The bad thing was that it was my AR15, my Colt and my Python, all purchased used with no Goverment tracks to my doorstep. Not that I am a one of the gun nuts, I just believe that Big Brother does not need to know all.

If I had been there they would not have taken down the serial numbers without a warrant and would have been asked to leave the property as there was nothing illegal going on.

I just believe that we have the right to enjoy our property without intervention as long as we are not infringing on the rights of others.

I believe they were checking the hot sheets to see if the guns were stolen ect...
However the computer now ties those serial #s to your address ??

They sell as many license as they can and then get out there and write as many tickets as they can.
A game wardens job would have to be a risky job....think about it,out in the middle of nowhere dealing with guys toting guns,never knowing if the camp has a bunch of guys who have been drinking....
This guy could have fined the boys for not having written permission as well....it is a law in WVa if you are hunting on someone elses property you have to have written permission from the land owner to hunt on his or hers land.
I felt bad for the boys getting hammered so hard,but it is there responsibility to make sure they have there license etc when hunting.

It's all about hunting regulations. If there was no hunting going on, on the property, and he was just running the tractor with a .22 or pistol on his side, I bet the warder would have just left him with a "havea nice day"..

Because the kids were hunting, he could have been using the tractor as transportation to cover more ground while the kids were pushung the deer to him.(just a legal possibility, he must consider)..

When I was in Florida, we used buggies and air boats to get arround. Because the deer were so few and far between, some guy would just use them to run the game. Talk about fair chase /forums/images/graemlins/blush.gif. These guys would run the deer down and over with the air boat, spin the boat on top of the game and drown them... /forums/images/graemlins/frown.gif... Not cool....

As hunters we need to follow rules and refuse to give the "anti's" more ammo. Some "hunters" dont follow rules. We need to accept that laws must be enforced and if it inconveniences us in the process, we need to deal with it. Bottom line, if we keep our noses clean, it shouldnt effect us. In some cases, like here, it will. Its not a conspiricy... /forums/images/graemlins/cool.gif I've had a run in myself, they were in my front yard when I came home.... Long story short.. I learned to respect things a bit more, even though I didnt really do anything wrong, I'm more concious of things now..

BTW, the question of cn someone fish in my lake w/o license? I'd bet no....

The reason I was busted with the gun on the tractor the warden said was safety factor.
You could not cover enough ground fast enough on the tractor to take advantage of any one pushing deer to me,as a matter of fact if someone is pushing the deer to you need to find a good place to stand or sit with your gun where you can see where the deer are likely to cross from one hollow to another.

I had the game warden stop by a week ago.. I was home because of car problems.. said they were looking for a 4 wheeler and had tracked it to my farm. Asked me if I had a 4 wheeler.. "No Sir".. did I know anyone who owned one.. "Yes.. the landowner's (who called you) nephew has one.. he rides up & down the street.. sometimes late at night making a lot of noise."

Now I had an idea of who it was.. young hunters on a nearby farm.. using the 4 wheeler to push out some deer. What's funny is.. the landowner that called the gamewarden had two hunters on opening day hunting.. after they fired at a deer on my property in my direction.. I ended up having to run them off my property. I called the landowner that day.

Yep, no way ANY LEO can search a residence without a warrent. A officer can search outside of the house. Depending on the location of a structure NEAR the house they could search that if it could not be construed to be part of the house.

RVs are NOT considered a residence since it can so quickly move from location to location.
