All true.. however.. none of it relieves liability from either party. If the tractor did not have proper sinage or lighting.. thent he tractor operator contributed tot he accident by creating an unsafe condition.. If it was a crest of a hill, then I still feel the driver was at fault. The law says you have to be in controll of your vehicle 100% of the time. If that meanse you have to slow down on hills and curves.. or when driving at night so as not to overdrive yourheadlamps.. then so be it. I've heard of a ticket for exceding a safe speed, or for going to fast for 'condition's, even though the person was not exceeding the posted speed limit. Obviously this means it is up to the driver to choose a speed at or under the posted speed limit that lets him drive safely, and maintain control of his vehicle, and not run into them because he is going to fast.. etc.

There may be other mitigating circumstances.. such as visual obstructions caused by the municipality or private owners partially blocking visibility of traffic ahead thru billboards, illegal sinage, parjed cars ont he row.. etc..

Been "roading" rubber-tired farm and contruction machinery from one place to another since I was knee high to a grasshopper! On the rototiller that came with my YM1510, there was a round opening in the center with a bolt clamp. I mounted an SMV sign in this with two pipe nipples and a "45", so that the SMV sign is straight up and viewable when the tiller is raised all the way up in the air. Drove back and forth to two different tilling jobs like this so far with no problem. The first one was pleasant, as the route consisted of 75% dirt roads. The second one...well, it's funny how one can drive a car to go take a look at the job and theres' hardly any traffic on the road, but when one tries to run a tractor down the same route... /forums/images/graemlins/shocked.gif /forums/images/graemlins/mad.gif

Definitely agree with Roy Jacksons comments about blind hills and curves!

We have a fruity guy in the neighborhood who does lawn work and drives all over the place with a JD riding mower pulling a snowmobile trailer with sides built onto it that he hauls his gas cans, weed whips, push mower, and other tools in. I don't think he even owns a car!

oh yeah, we also have a rental place in town that has a couple JD CUTs as well as a 580 Case TLB and a Cat 910 FEL. I see folks go get these and drive them back and forth all the time.

I've driven that road before. It's less than a mile long, perfectly flat, with nothing but vineyards on both sides of the road. There's no hills to crest, no trees, bushes, or signs to obscure the view. The road itself is about a foot or so above the surrounding vineyards. The spraying rig trailer he was towing was a huge red tank with a reflective slow-moving-vehicle sign on the back. I don't see how the Escort driver could fail to notice that as he was approaching at 50 mph.

Here, in Lousisana, farm equipment is absolutely legal on the roadway. As others have posted, SMV triangle and lights are all that's required. Doesn't even matter about oversize equipment. I can drive my tractor and 12' disc down the highway - no problem. But I have to get a permit to haul that same disc on a trailer. Go figure.
