We find ourselves in the same position regarding my M-I-L's farm. My question is ... has anyone ever fought annexation and won?????

here's an update---wifey called city administrater today and was told that they can only annex if they have 60%(based on tax evaluation) favorable votes. This appears to mean that (based on evaluation) I only need 41% NO votes to stop the proceeding!!! Next step--get on the county website for names and mailing addresses of all who are in the "zone" and invite to a bar-b-que to find out who is in and who is out. Kinda like a garden party!!

Good plan????

Sounds like a good plan to me! Of course, depending on how well the neighbors all feel about each other either 1) there will be MANY 'no shows' because they don't want to associate with particular people or 2) there will be fistfights because they don't want to associate with particular people or 3) everyone will get along, have a good time no matter which way they feel the annexation should go.

If it's not a huge area wouldn't it be both easier and more personal to visit each neighbor and invite them to your "shindig"? That way, you may get an idea of how each of them feels about the annexation whether they come to the "party" or not. Also, that could be quicker than finding all the addresses and generating the mailings, which in many/most cases will be tossed without opening with the other unsolicited mail.

If it goes well, you could conceivably be hosting a get-together every year from now on.

Most of the time annexation is a bad thing. Do you like paying more tax, I don't? In Kentucky, when the city desides to annex, they just go and do it. They don't have to have a vote on this. You can like it, or sell out, and move somewhere else. A few years ago my property was annexed that way by the city. Now I pay county tax and city tax, and anything else that the city comes up with to charge tax on. In most small towns the city is always hurting for money for this, and money for that. I think that the elected pinheads at city hall set around and try to think of anything to tax to get money for the city. We pay for city garbage pickup, and now the city is thinking about putting a tax on garbage pickup. What will they think of next to tax. Before long, the city will charge property owners that live in the city a tax to walk into city hall. For me, annexation has been a bad thing. Although, I know some on this board likes annexation, and likes paying all kinds of city tax. I don't

I own a 112 acre farm in another county that is so far out, that it will never be annexed. If I have to, I can sell my property here in the city, and build a home on my farm, and will never have to worry about annexation again. I might do that some day to.

It seems like people are getting taxed to death. Most tax payer's money is wasted on unscrupulous things that city elected pinheads come up with in city goverment.

Frank, I've never known anyone in Texas to fight it successfully. Not saying it hasn't happened, just that the people I know and the three different Texas counties I've lived in over 25 years, I've never seen it happen.

I think I live sufficiently far from the Metromess (30 miles from Fort Worth) to be safe for a long time, but as we speak the City of Fort Worth is busy annexing land in adjacent counties. Doesn't seem right to me, but they get away with it.

</font><font color="blue" class="small">( bought 10 acres 4 years ago with 10 acres zoned ag to the north, 10 acres to the east zoned ag, 2 parcels across the street, [south]-one 5 acre zoned ag and one 5 acre zoned res(one house per 5 acres), and a high-density development across the street to the west. Yesturday got an official notice from the city of their intent to annex all of us! I have a good well, good and currently approved septic(county) and a new new home approx. 1/4 constructed. Worried that they may force city water/sewer hook-up, change zoning to heavy residential (I've already applied for ag exemtion).

Any input/advise/or experience appreciated!!

If you loose AG status the real estate tax will really jump up as non ag property is taxed at a much higher rate than AG.

As far as I can tell, you haven't provided us with your location. Laws vary from state to state, assuming you are in the US. We need to at least know what state you are in, if we are to help in a meaningful way.

Locally, annexation also equals bad things for the property owner (higher taxes). State gets their share, county takes more and then city wants more on top. At least here, the state and county taxes provide for basic fire and rescue services, paramedic services are billed to the individual. So, town taxes pay for....... extra what? I don't think the elected representatives anywhere reflect the wants and needs of their constituency as much as they do their own desires.

In my area it get voted on. 50% of the city doing the annexing has to approve and 50% of the annexed area has to approve.

The last time they wanted ot annex us was because there was going to be a casino going in about 5 miles down the road. The casino got canceled and so did their interest in annexing us.
