I would like to propose a new general forum: Dealer Rants and Raves. I am sure we all have opinions we would like to express about our relationships with dealers.

There could be a problem with that. There's nothing wrong with telling about your good relationships with a dealer, and naming that dealer. However, if you have complaints about a dealer, that's another matter. For one thing, if you name a dealer that you have a complaint about, you may be leaving yourself open to a lawsuit. And for another thing, it just isn't fair play to criticize someone, a dealer in this instance, without the alleged offender having a chance to respond. Bad situation when you only hear one side of a story. Naturally, many of us on the forum are friends, and we want to believe our friends are telling any story factually. However, anyone can register, become a member, and post messages on the forum, and the rest of us may know nothing about that person, since the information provided in the profile is voluntary. What would happen if one dealer, without us knowing he/she is a dealer, posts false information in order to hurt a competing dealer?

So . . ., you can certainly post messages now, in the different forums, about your experiences with dealers, but if a message contains derogatory information about a dealer, it's best that the dealer is not identified.

If the poster is honest in what he states his opinion is, there should be no worry of a lawsuit (or of losing one).
If, on the other hand, that person intentionally falsifies his/her story, then they should worry.

Rick, a person can be honest in his opinion; i.e., what he believes and still be mistaken. So a person might need to not only be honest, but also be able to prove he was right. And as I mentioned, how would the rest of us know who the poster is and whether or not he's honest? And since anyone can sue anyone else, you can win a lawsuit and still be out hundreds or thousands of dollars.

You are right in everything you say. However...isn't that the truth with anything/everything that is written on this and every other site? I can sue you if you write something I don't like...doesn't mean I'd win (does anyone ever win in a lawsuit other than the attorneys?), you can sue me, and on and on.

I realize that as moderators you go to great lengths (and do a super job) to keep this site civil, but darn it, there is always the possibility of being sued for ones actions. All each and everyone of us can do is be as honest as we can be or suffer the consequences.

America, what a great country.

Bird is right and he says it better than I could. But even beyond that, I believe the site takes the higher road and frowns in general from allowing negativity from manifesting itself too much here. So passing information along without slamming anyone is generally the way it's done. The moderators here do a superb job of keeping up on material shared.
So post about dealers who need to be recognized and pm someone if you see they might be going somewhere you may have less than desireable dealings with. Out in the open just doesn't work.

Bird you make a good point. But would it be as bad of a problem if the dealer one complained about was not to be mentioned? I know from your standpoint as a moderator you're really wishing for more things to enforce... /forums/images/graemlins/tongue.gif but I think if someone just wants to vent some steam to people that would understand, without doing damage to another's business by naming them, it doesnt seem like a big deal to me.

Honesty and truth have very little relationship to outcome in a court of law. Just being named in a lawsuit means you have lost (not the decision, just the ordeal.)

The posting of complaints about specific dealers is covered under the Forum Rules forbidding "personal attacks of any kind". This rule has served well over the years.

Yes, you can certainly vent, describe, relate (or whatever) any problems without identifying the dealer. And that has been done many times, usually in the forum that corresponds to the brand of tractor being discussed.

Personally, I don't see a need for a separate forum for that purpose, but that's just my personal opinion, and is solely at the discretion of Muhammad.
