The old saying must be true that nothing runs like a deere. I hear they went running and crying about some advertising Mahindra has done. Specifically the deere john ad. Seems to have forced Mahindra to pull it. What a shame it was a great peice of work!

I can only see one purpose for this thread and that is to start a flame war.

Whatever, i just found it interesting that John Deere would be scared enough of a red tractor to pursue a defense to this advertisement.

On that subject, we were told by a John Deere dealer (I won't mention any names), that Mahindra was #1 on Deere's list of concerns for the future at their dealer meeting. They said that if anybody was gonna give them trouble it would be Mahindra. It does seem like more and more Deere dealers are taking Mahindra in my area because Deere is trying to force them to merge.

Strikes me that fear has absolutely nothing to do with it.

Lawyers would have everything to do with it. Corporations use lawyers to protect their intellectual property, trademarks, copyrights, logos, etc. I would suspect that Deere believed that Mahindra violated its rights of ownership of one of its properties. I would also suspect that if Mahindra pulled the advertisement then there must have been some very legitimate basis for Deere's action and Mahindra probably had little choice but to pull the advertisement.

Some companies are very picky about protecting their intellectual property and persue violators very aggressively.

Now in the spectrum of the tractor market here in the US, there is no question that Mahindra is an upcoming force to be watched. They have a wide range of machines, can fill most product niches reasonably well, seem to have good distribution, and are ranked 4th in compact utlity tractor sales with Kubota #1, Deere #2, and Case/New Holland at #3. I've never been able to figure out who is #5, but I suspect it is Massey Ferguson or perhaps Cub Cadet? Jinma, under a whole list of names, could also be #5??? Kioti would probably follow this group in sales? But the reality is all the companies after Mahindra have very small market shares because the top 4 brands occupy something like 93 to 95% of the total CUT market.

I was unaware that the brand of tractor you own restricts where you can post. If so, there are an awfully high number of posters violating this restriction. :)

I agree with Bob. Why would Deere (or any other company) want to let Mahindra use their product to advertise against them?

They're scared to realize how many so-called Americans are willing to bypass domestic-based companies to buy foreign for a few bucks less. Seems to be no loyalty at all...

It's a race to the bottom.

Its an international market, I'd venture that a company like Kubota or Mahindra who makes their financial investments in the US does more good for our workforce than say, Deere, who continues to build more factories and bring in more product from abroad. If your goal is to support local economies buying based upon the location of a home office is very short sighted.

So what is the US Investment base and total number of US employees for Kubota and Mahindra versus Deere? I would that Deere's total contribution to the US economy would dwarf most of the other makes.

That being said... Why did John Deere use Kubota in loader cycle and pull capability video demonstrations on thier website? What's good for the goose is... well you know. If Deere is so paranoid of loosing market share then they need to make tractors more affordable without loosing quality.

Also, if anyone thinks any of these brands are poster children for American manufacturing and ingenuity they need to check the corporate ownership and status of the prospective brands. None of these lines mentioned are 100% U.S. as far as I know.:confused:

As far as posting only in threads that your tractor ownership or interests dictates or else... that's soft bigotry IMHO :mad:

P.S. I think all brands mentioned are fine tractors. Apples and Oranges. IMO

Tom, it is not as cut and dry as that. The legal issues with intellectual property often become messy with HOW the brand is represented, or HOW the copyrited materials are used, not the fact that they are used. There are some legal ways to use things and there are some ways that run afoul of the law.

As none of us are privy to the actual documents or findings, we can only presume that if Deere put legal pressure on Mahindra, and if Mahindra pulled the advertisements, then Mahindra probably crossed the legal line in HOW they used the representations of JD.

All fo the tractor companies have "comparisions" to other brands on their websites, that is within legal bounds. Also realize that Mahindra has prior ads which showed its products with Deere and Kubota and those ads ran for a long time, so it was not simply a matter of using other brands that set off the problem. Truck companies compare their vehicles all the time, as do car companies. But again, it is not illegal to make comparisions, but it is illegal to make false claims about other companies, misuse likenesses, abuse trademarks, etc.

Bob,

As I recall it was a sarcastic jab at Deere using the Dear John letter reference joke. It's understandable that JD would get upset over the ad but suprising that they would qualify it's effectiveness by pressuring it's removal however... i'm not a JD board member and have know idea how they pick their battles. Please excuse my run on sentence.:confused:

More money for the lawyers I guess:p

If I hadn't seen the word "CHINA" so prominently displayed on the brand new "domestic-based" Deere I was interested in, this "so-called" American might actually own one. Paying premium bucks for "Made in CHINA" just because it is painted green is not my thing. :(

On the other hand, between my ML112 FEL and 509 BH, I figure I'm about 50% (by cost) made in the good ol' U.S.A. with my Mahindra.

Funny how that works, heh? :)

Funny in some ways but sad in others. I feel if we get in a REAL world war were not gonna be able to manufacture the massive amount of weapons needed to survive much less win. Are we gonna get China to build weapons for us to defeat them? I think not. Wake up Americans!

Not necessarily. few years back JD used their might to intimedate several importers of chinese tractors to change colors, Agracat being the largest at the time, but Lenar was also named. These tractors did not copy JD green chassis, hood and fenders with yellow wheels, they were easily identifiable as being different with thier black chassis, Look how many walking fingers you see for yellow pages, similar but different. None of these companies had the money to fight.
Mahindra may well have been OK in this ad, (I didnt see the ad and I am not a lawyer). Could be they just didn't want to into battle with such a large corporation.

As far as US content. I could probably build a case (no offense CIH) that the chinese tractors brought in by small importers have a larger US component included in the sales price than many formerly made in USA brands now sold. Between the more involved assembly and US based quality control operations needed and US funded warranty operations, there is a lot of value added stateside for these tractors.

That said, I do buy American cars and trucks (with considerable imported componentry) so long as I don't have to pay extra for it.
