Connecticut Taxes the machine, tax to get machine to your home or farm, TAX is if you think about purchasing a tractor, # 1 tax state 71 cents tax per gallon of fuel, so wait did I pay tax for my machine, YES I can't wait to leave this state, and now I hear Connecticut is 3.5 Billon dollars in the red, the only thing good here is beening in the "RED":laughing: Connecticut #1 in taxes, and yet I live here, someone just shoot me so I can show some "RED":laughing: I'm beat going to bed !!!

Maryland and Pennsylvania both tax unless you have a business that owns the equipment be it farm or other.

I'm still confused on this. From what I've read in the PA tax guidelines, only non-profits are exempt from the sales tax. Then I've also read somewhere that there are exemptions for ag, processing, manufacturing operations, and other businesses. But from what I've heard, I'm pretty sure almost any business can buy without paying the tax, at least, at the point of sale.

The dealers I've talked to so far in PA want to collect the sales tax. My business would be buying this, and I've rebutted paying the tax, but they've held firm. So guess what, if the PA dealers want to collect sales tax and do who-knows-what with it, I'm taking my purchase out of state. . . . $1200 is too much money to leave on the table.

Sales and Use Tax Exemptions for Agriculture
Are sales of agricultural equipment exempt from tax?

The sales and use tax does not apply to sales, including rentals, to a farmer of farm equipment used to raise livestock and poultry, prepare, irrigate or tend the soil, or plant, service, harvest, store, clean, dry or transport seeds or crops. Farm equipment is treated as personal property entitled to sales and use tax exemption even if attached to real property.

Are there any exemptions for food processing?

Yes. If a farmer is engaged in processing food for sale, there are exemptions available for purchases of capitalized equipment and consumables. These exemptions are explained in Business Tax Tip #9, Sales and Use Tax Exemptions for Production Activities.

Does the tax apply to sales of livestock?

No. Sales, for agricultural purposes, of livestock, including poultry, are not taxable. Also exempt are sales of feed or bedding for livestock. The raising of horses for breeding purposes is an agricultural purpose, but the maintenance or sale of riding, show or race horses is not. The raising of livestock by members of 4-H or similar organizations for agricultural educational purposes qualifies for tax exemption, but the maintenance and sale of pets, dogs for breeding purposes and animals for testing purposes does not.

Are there any exemptions for agricultural supplies?

Yes. When sold for agricultural purposes, seeds (including plants and seedlings), fertilizer, lime, fungicide, herbicide and insecticide are exempt. These items are exempt when used for raising vegetables at home but are not exempt when used to maintain a flower or other decorative garden or lawn. The tax does not apply to sales of containers used by a farmer to transport farm products to the market or to sales of baler twine or wire. Fuel for use in farm equipment or a farm tractor is also exempt.

Is aquaculture given the same treatment as agriculture?

Yes. Commercial aquaculture and agriculture are treated the same way for sales and use tax purposes.

Are tax numbers needed to claim agricultural exemptions?

No. It is not necessary for purchasers to register with the Comptrollerç—´ Office in order to claim agricultural exemptions.

What records of sales should vendors who sell agricultural equipment and supplies maintain?

When the record of sale does not clearly include all elements necessary to justify exemption, a vendor may ask for a signed statement to indicate that the customer is a farmer or that the purchases will be used only for agricultural purposes. See a sample certification statement. Even if a certification is provided, a vendor must, however, collect the tax if he or she knows or should know that the purchase does not qualify for exemption.

What kinds of items are not exempt?

Only those items sold under the specific conditions described in this publication are exempt. Sales of hand tools, carpentry, cleaning and maintenance supplies, materials to be incorporated into realty and items for personal use are taxable.

Are there any special provisions for sales by farmers?

Yes. The tax does not apply to the sale of an agricultural product by a farmer. Sales of flowers, sod, decorative trees, shrubs and any other product usually sold by a nursery or horticulturist do not qualify for this exemption

Just curious. Some states I think have ag or commercial exemptions.

PA has a new law that is not widely known. If your land is in a Clean & Green program, any equipment you buy to farm or maintain it can be in a sales tax exempt status. Now this does not include items like lawn mowers that you would purchase anyway. I bought a new 74 HP tractor last year and the dealer informed me about it. To be sure I checked with my accountant and he knew of the law and said I was good to go.

I also did some searching on the net and confirmed what the dealer and accountant told me, but do not have the link.

I live in NY, dba as a farm and file a schedule F with income taxes, and have been searching for a new CUT, dealers state I need to provide tax form ST-125 claiming I am exempt for sales tax due to using the tractor for ag and will not have to pay NY sales tax

No tax here in KY if you fill out an Ag exemption form. If you are growing feed, food or animals for food production, you qualify.

We do not have a dba, but do claim income from our very small farm, most years we break even after deductions. 12 cows, sell hay and firewood ect. Filled out the ST-125 and do not pay sales tax on any purchase that has direct use on the farm. That included tractor and fuel. Make out a little better on the diesel, but after "special "taxes, fees and delivery gas is 2 to 3 cents higher than at the pump. We pay it because it is nice to pull up and fill up and not have to hoist cans.
