Do you have the right to drink on your own private property? I have always thought in the past that a man has that right in his own home but it seems that I may be wrong according to this news story in the news

What's your take on this story, do you feel like you just lost another "right"? /forums/images/graemlins/confused.gif

He wasn't at his own home. I would presume that the police were called for a reason.

My situation has a little different twist. I do not live inside the corporation limits of the city. However the city limits are at the far edge of the road I live on. That city has a law that you cannot drink an alcoholic beverage "in view" of any city resident. The subdivision across the road backs up to this road. If I happen to be out in my front yard enjoying a nice cold adult beverage, I risk getting cited by the city police because I can be seen by someone in their back yard. I was out on the tractor, mowing, and the local police showed up(out of his jurisdiction) and requested I disguise the can with a coozie or risk getting a summons to Mayor's Court.

I'd like to hear someone from that 'city' explain how one municipality thinks it has the rights to pass ordinances applicable to another outside of their boundaries?

As you said, you were "out of his jurisdiction" if your place isn't within the city limits. It would seem to me that the city ordinances only apply within the confines of the city, or that's how it should be.
Even though you might be able to force the issue and drink while mowing or whatever you'll probably incur some special attention whenever you get onto the street and within the city's legal jurisdiction.

There is always truth that is left out of these stories....Bottles were thrown at a crusier, so the Police investigate and break up a party. Then you got bozo the drunken clown mouthing off...They were justified no doubt...

This is the same police department that got the address's mixed up and broke down the door of a senior citizen in the middle of the night, gave him a heart attack when they started shouting and shoving him around resulting in his ultimate death. Using the word "Bozo" might be correct, but attributing it to the person who was arrested is incorrect. It is the Boston Police Department that has an over abundance of Bozo's. Some will defend the police just because they are the police. Others will also realize that just because they are sworn to uphold the law, doesn't mean that they will always do so. Other departments that come to mind that have officers that believe that the law doesn't apply to them are Milwaukee, Los Angles, New York City, New Orleans, to name a few. It is a shame that the United States Justice Department hasn't seen fit to look into police corruption in recent years like they did 10 years ago.

They made the private party a public safety concern when they allegedly threw bottles in the street at a police car. We have no proof that bottles were thrown, nor do we have any proof as to where the alleged bottles were thrown from. If bottles were thrown, then why didn't they pick up the broken bottles and check them for fingerprints to prove who the guilty person are? Sure, there are a lot of good police officers in this Nation, but we also don't have a shortage of those that believe that they are above the law. If every law enforcement officer were to have the integrity of Bird, the profession would be a lot better off. We do have proof positive that the person arrested was attempting to video tape the situation by the admissions of the police. We don't know who or what drew the police to the party, but it isn't uncommon for the police to stop at a home when they hear the noise of a party going on. As for his law suite being "frivolous", that is your opinion. I see this as a test of the recent enactment of laws that keep giving the police more powers, and taking civil liberties away from the citizen that was granted those liberties by the founding fathers in the Constitution and the Bill of Rights.

I agree, also, police have a double edge sword. If they let the guy "go" and he latter committed a crime or hurt or killed himself, the police would no doubt draw fire for not adequately handeling the situation. This is quite the isolated case, if it was rampant, I'd be concerned.

Junk,

All of those departments look like the Vienna Boys Choir compared to the Detroit PD. Bad boys, indeed.
