Well, after I called the local cops, the DMV and County Cops, I drove my NH TN70A to the local diesel truck stop  (2 miles one way) on public roads to refuel. Two lane roads, lightly traveled, good sun light and good visibility. 4 way flashers on, headlights on, SMV mounted. So much easier than moving fuel in 5 gallon yellow diesel cans. I don't have a truck, so carrying smelly diesel in my sedan was ruled out early. Carried four 5 gallon diesel cans in the bucket. I got 20 gallons in the cans and filled the tractor. Entire trip took 0.3 hrs on the meter. Traveled in eighth gear at 1500 rpm. Smooth and easy. And not a drop of stinky  diesel spilled in my sedan.

PS One car passed me on a curve, marked by double yellow lines  . Darwinism in action.

Nobody within 5-10 miles of me sells diesel. So driving the tractor there is out of the question. And it's taxed on road diesel.

If I buy more than 100 gallons in Wisconsin I can get my state fuel tax back (31 cents per gallon). Fed tax, not sure. I assume their is some federal form, I have not yet looked for it.

PS I would never drive 5-10 miles one way, even though I drove 4 miles round trip. 1 mile of the trip is done my street, with no traffic at all. So only 2 miles round trip with any car taffic.

Doc,

Can you elucidate more on the getting back the tax money on tractor fuel?

Thanks,

I had a bulk tank at the farm. When we moved to the new place, I didn't need so much fuel any more. Rental on my tank, plus a fill-up that was a months worth, now would carry me 6 months. I don't want fuel around that long. What to do?

There's a gas station just down the road from us that has an Off-road diesel pump. They sell quite a bit from what I'm told. (It ALMOST outsells "on-road" at this station) So, my problem is solved. Every time I need fuel, just a quit (less than 5 minutes each way) trip to the quickie-mart, and we're in business.

In the middle of Kentucky, no one even gives a tractor on the road a second look.

For the federal 24.4 cents per gallon tax, you can go to the IRS web site, www.irs.gov and search for diesel. You will find the correct form and instruction sheet. This applies only to undyed fuel being used in off-road applications.

For your state tax, that will depend on what state you live in. Check with your state revenue department for details.

My question would be this If I drive to or from the station with off-road diesel already in the tank and get stopped am I subject to fine?

My guess would be yes, whatever your reasoning might be.

Don't get me wrong, I'm not a purist as I have driven my tractor to several neighbors within several miles of my home and I use off-road diesel too. Interesting conversation though.

My guess would be no, at least in kansas.
But if your tractor has a current license plate, then maybe yes......are you thinking about commuting to work in your tractor?

I would bet that there is no provision made for CUTs running off-road diesel on the streets.

I actually do commute to work on my 40D, but then our home is the office as well. :D

I also prefer to drive my tractor a few times per month to my local gas station for fuel. It is less than 2 miles away for me so it is alot less hassle than transfering fuel in cans. If it gets to the point were I need fuel more often then I'll investigate a storage tank or a transfer tank for my truck.
