I saw that.

My line of thinking is it's all on the captain, but I could be wrong. The timefram however leads me to believe he should of known a bad storm was coming as well as the white swells forming on the lake 5 minutes after going out.

The question then becomes what what the company's procedures when bad weather was coming?

My added line of thinking is that the company can't blame it all on the captain.

The operator's liability underwriter is likely to claim "act of god"...

That's a good get out of jail card for a written warranty, but when it comes to liability and insurance issues when dealing with a business that is dependent on the weather to generate income, I don't think an "act of God" will hold water.

Now, if a tornado would of happened 10 miles away from the boat, with the boat sailing in clear skies and that tornado picked up a truck and sent it right dab on top of the boat and sank it, THEN you might be able to stand a chance hiding behind God.

When I worked for some commercial rafting companies in West Virginia and New York, there was actually a water level that was too high to run a paid commercial rafting trip on. That said, if the trip was cancelled due to high water, we would still kayak it "on our own" because we weren't paying anyone to take us down the river and we assumed all liability.

The people on this boat were paid customers. They have a safe assumption that the company they are paying knows when it's safe to go out and when it's determined not to be safe to go out due to the weather conditions.

On a sidenote, one piece of information I did come across this morning was the apparently the operator of the "boat" had changed their routine where they do the water portion of the tour first before the land tour.

If this is the case, it does lead you to believe that the operator of the "boat" was aware of potentially bad weather and was trying to beat the storm by hitting the water first.

Well, lets see now. Branson. I live here. Outside of the town just a bit. Yep, just a big tourist town. Hillbilly with his hand out I say. The reason I moved here is I got laid off of a good job in Springfield, Mo, (they closed the place) and found another with the same company in Harrison Ar. The wife still had a good job in Springfield. I asked the employer how far I could live away from Harrison and they said Branson. Well since Branson is halfway between Harrison (my job) and Springfield (her job) That is where we moved. My company paid for the move, so I couldn't beat that.

During the tourist season, you just learn to stay off of certain roads (mainly 76 country music boulevard) And you will do fine traffic wise. It is all good. I haven't been to a "show" in years, and haven't been to very many of them. I haven't been to "steal your dollar city" (Silver Dollar City) in decades. I just don't have that kind of money to burn. But hey the Branson area is kind of a beautiful place to live. Really pretty in the fall. Come on down. Us Hillbilly's need your money ! :)

I've got to ask, what comments lack "maturity"?

Long story short, it was a F up and someone is going to pay.

No way to make it look at better with "mature" comments IMO,

What comments? You can find a two bit redneck trailer park anywhere in the United States.

People died. You contributed to shifting the conversation toward degrading comments about the location. That seriously lacks maturity.
