Tim.......I really do appreciate YOUR thoughts and concerns......Don't really know what to do because sure as the devil human nature is gonna say that after I get the gate up somebody is gonna have a problem..........

JJ......yes it is a 30' shared easement.......Actually several of us are on a road maint agreement; but I am the only one who maintains my part of the road.......Yes, the city/county uses it to get to the water tank and one guy below me; but neither ever lift a finger to do anything which really galls me because the city/county came in 5 years ago and imminent domained 2 acres across the road from me to build that lousy water tank........

Yes, the gate will be wide enough for very wide loads.........NOW you guys have me thinking about a solar powered electric gate with remote control, a switch panel there at the gate for folks that do not have a remote but know the panel combination, an IR eye that senses when to close, and some kind of audio/video communication system for delivery guys and such..........any ideas on the cost???????

Yes, I could just gate and fence my place; but the setback of my house to the road is perhaps 50 feet and hate the thought of sitting up here in the loft of my A frame lookin out at a fence when all else is as God created it...........Knowing me I would only be satisfied with one of those King Kong fences that you see in those movies.........

Dennis, One other thought that was mentioned by the judge. What if all property owner decieded to install gates at the beginning and ends of their property lines along the easement. That would mean I would have to open 6 gates just to go to the store for a coke. If I had allowed the gate to remain it could have set a precident allowing all the property owners the same right to have gates. The Judge looked at the reason the easement was originaly made and let common sense make his rulling. The easement to my property was original created by the previous owner so he could subdivied his property in half and sell the back half, witch I now own

If this has been asked I missed it.
Have you thought about talking with all the owners and asking about a gate at the very beginning of the road to protect all the people where you all would share one gate and it's cost and benefit.

Dennis, Yes they make several gate systems that work on battery power. In most cases, there is a trickle charger to keep the battery charged. Both of the systems that I have used also have a solar charger. Given that, a fully charged battery will let you open the gate about 75 to 100 times on the battery, and in a situation like yours, that would be enough. It is activated by remote control, and closes automatically. If you know some electronics, you could have a small CB handheld radio transmit whatever sound it picks up at the gate. on a certain chan , of course hidden out of site.

I would be tempted to contact the county and tell them that you have seen people trying to break into the water facility and are concerned about what they might do to the water supply. After all there is a lot of concern about domestic terrorism these days, not that I think that is the case here. They may well put a gate up for you.

Mark..........I got off of the phone with the county/city a while ago today.........And for real did advise them about folks setting off my road alarm 3 times in the last 6 months at 2 AM and then finding them parked outside of the water tank fooling with the lock on their gate.........THEY have no problem with me putting up a gate; but I need to double lock and use one of their locks..........

Since I began this thread a great development has happened........While talking to the ol boy who owns 10 acres next to me and has a paved road that passes across another section of my property (IN THE PAST HE WOULD NEVER THINK ABOUT ALLOWING AN EASEMENT on his property where the paved road enters his land from the state highway)
Anyway......NOW he will sell me the 10 acres with a paved road to MY PROPERTY.......easy to put in a drive to connect with my "road" system on my property.............

So.........we signed a contract and my mortgage company is totally positive about the deal.......we sign the loan application tomorrow.............

So......It may be a moot point about the gate and openers down on the dirt road........just put a cable across it and who cares........I wont come and go that way...........but a cable will keep the wanderers out..............and as for MY NEW PAVED ROAD.....there will be where the auto gate is put to use.......maybe a month off...........so hang in and thanks for the help.........GOD IS SOOOOOO GOOD........Dennis
