Forget impressions, what does the operators manual say on the use of the chain brake. If you used it per the manual I would pay with credit card if I needed it and send registered letter asking for refund and the reason. My guess is NY state has some strong consumer protection laws on such as warranty. Check those out. But look at your manual and warranty. It is what you can prove. kt

In my opinion, if I used the chain brake enough to wear it out, I think I would give up using a chainsaw while I was still alive. My view on a chain brake is for protection on kickback and for start up. How do you burn out a chain brake unless your constantly engaging it at a high RPM? I can see burning up a clutch, but never a brake. My saw (Sachs Dolmar now owned by Makita) is 18 years old and the brake is still fine and I've been thankful it was there once so far. Just my two cents worth and Yes I would be PO'ed if my dealer did the same thing.

I just re-read your write-up again and you said the chain brake was stuck. That tells me it is working but it wouldn't release so how can it be burned up?

I was thinking it was worn out since the dealer said it was but he obviously need to fix something that wasn't covered under warranty to make a little money.

I was planning to buy the same saw because of the 5 year Warranty... touted as the best consumer warranty in the industry...

I glanced over the warranty and did not find the brake as a named exclusion.

Most Consumer Protection statutes require an estimate authorization to begin chargeable repairs and approval to exceed approved estimate.

I believe you are within your rights to request return of the saw in the same condition as you left it in the absence of your approval for billable services.

The only new car I have purchased included brakes, wipers, battery, fluid changes, etc., for 4 years or 50,000 miles. The only exclusions are tires (Covered under Tire Mfg Warranty) alignment after 1000 miles and cosmetic defects after 1 year.

That's a good new car warranty, my new truck says all componets except wear and maintence items.

That's right, the brake was engaged and would not release. I didn't want to force it. Had I known it wasn't going to be warrantied, I would have taken it apart myself. I'm going to ask to see the burned up brake.

While it may not have been a warrantable claim, I think your dealer ripped you off. If he's good at ripping people off, he'll have a "bad" brake to show you whether it was yours or not.

Did he detail the parts and labor charges? I can't imagine it taking more than 30 minutes to change it out.

I do not recommend leaving a chain saw 2 stroke motor idling for more than a few moments. Usually if you need to set it down, just turn it off. I also never use my chain brake. Not even to start it. I just don't put my hands or anything on the bar while starting. I guess anyone could slip and fall or something. I'm not the safest person on the block.:cool:

It's a BMW 325it... my one and only new car.

I ordered it here for pickup at the BMW factory in Munich when I learned I would be working in Germany for an extended time.

I saved about 7k with European Delivery (5k off the MSRP and at least 2k not having to rent a car over there)

45 thousand miles so far and no issues... the first 3 thousand were in Europe... mostly on the Autobahn.

How does a chain break wear out? Under normal operating procedures the chain should not move at all when the saw is at idle. The break is only there to stop the chain if the saw is given gas to rev up the engine. If the saw idles properly then in theory you never need the chain break, and it should never wear out.
