As for calling you "cranky" I thought that you, being from the New England area, would have been called much worse than that! Afterall, you folks are known by the rest of us as being generally unhospitible, unfriendly and all the other cliche's that us mild mannered friendly socialable midwesterners can sling at you uppity blue bloods.

I agree with you,anything else is stealing. Some people will fight over an inch of ground,I had a piece of property surveyed and the survey indicated my property was about 30' feet on the other side of the line fence for about 150' feet in length. The property had not been surveyed in probably 100 years,well what happened was as the years went buy the fence was gradually moved in my direction the old man who's property I adjoined was bedfast and he was certain the fence was in the right place and was straight and true,you could sight down the fence line and see a curve. The old folks were "up in arms" so I just let it ride and never pushed the issue,I figured 30' of property out in the country and we had been good neighbors for years why make a fuss?I just sunk the survey markers below the surface and let the fence stay where it is.

thats why you don't survey land that has used the fences as the property lines for a lonnnnnnng time....someone originally wrote the "specs" for the land, but what they wrote and what they did on the ground, very seldom matched. so why try to make it match what was written, just go by what everyone have agreed to for years..

1. First you would be a fool to buy a piece of land and not have it surveyed.
2.I have never bought or sold land through a bank that did not insist that the land be surveyed regardless if it was a 1 acre lot or a 100 acre farm..
3. The instruments they used way back when were acurate for the most part maybe not quite as acurate as a laser but acurate.
IE: The survey I had done found the points mentioned in the deed (the neighbors fence line was off but the points were found with laser technology using the original deed.
Another case in point,another neighbor recently had his farm surveyed and the surveyor crossed the road and found a point which was used for a refrence on my original deed,the points lined up exactly from his farm to my farm.

I have a friend who is our county surveyor and I have helped him on different jobs,sometimes the best thing to do on an old survey is to try and use the old method of chains and a compass to measure and 9 times out of 10 you will have an acurate survey,the problems that sometimes occurs is using a laser on something that was originally measured with chains/rods and a compass and then you can get a very small discrepency IE: because of the accuracy of the laser.


Its the equivalnet of squaring a building up,you can use batten boards and a string to get a foundation squared or you can use a laser,they both get the job done right if the instrument is right and used right.

I have not finished all the thread but I fail to see why you think he has to live up to your expectations on his own land. Just because you took it upon yourself to maintain his land does not give you any say in what he does with it. By your feelings if I was to fix up your house then I would have a say in how you can live in it or what you can do to it. Does that seem right. I look at it like this, if you want to maintain his land then deal with his atv. If it bothers you so much talk to him about it instead of ploting on here. Ask him not to tear up the field as you are trying to keep it looking nice for both you and him. Don't start a feud by building a fence as it seems you have a good relationship. I do not see how building a fence will improve anything nor cost less then fixing a few ruts from time to time. If in the end someone tried to take any of my land it will be a very, VERY expensive attempt. At the end of the day think how you would feel if someone tried to take your land you bought with your hard earned money. If he don't sell then so be it.

I feel sorry for you guys with problem neighbors as there is only one real way to deal with it but that has been outlawed a long time ago. Good luck to you guys and hope things work out for you.

sometimes a survey works, sometimes it doesn't...i agree i would never buy land without a survey, but some of my land has been in the family for about 50 years...without a survey, going strickly on the fence lines as property lines, thats the way it was bought, and has remained, until 5 acres were sold about 8 years ago...everything was fine, the person that bought the 5 acres was happy..till 3 years later, when he had it surveyed, and it was only 4 acres, and the line that had been accepted by all for over 50 years, and by the buyer at the time of the sale, was off by 60ft....thats why i am so adamant about keeping the fence where it is on the other side, if the property line moved 60ft, i would end up with my property line through the middle of the neighbors house. the last property i sold, i told them i was selling them to the fence, and the buyer had it surveyed to match..the neighbors had put the fence 10 ft over on my property, weren't willing to let me move it, an i wasn't willing to fight over 10ft. so i solved it by selling to the fence...

First, as a good neighbor he should respect his neighbors privacy, just as we do his. I dont expect him to not use it as he wishes, I only wish he respected that I have tried to keep it neat and not ruin it with his silly ATV.

The fence will keep the noise down when I am trying to enjoy my back yard that his playing is disrespecting......and every holiday it is constant, all day up and down....I dont cut grass at 6 in the morning, my neighbors are still sleeping. He can do as he pleases, even pay the boy that cuts the other parts more to cut this, I aint doing it anymore...........
