So.. which one of us are you accusing of not paying our fair share. I assume by this accusation, that you have credentials as a tax accountant, and are familiar with the practices and tax law in all the jurisdictions concerning the people here participating in this forum, and / or that you are a govt' official in a tax dept? Which is it? and who?

I am not accusing...tax cheating is a widespread practice. and yeah...i am a CPA but no I don't know much about CA tax law since I don't do many tax returns from there. but i said that already.

That implies that you believe that one or more participants to the thread are trying to decieve the gov't and not pay their fiar share of taxes.

A review of the messages, shows that we have one fellow thinking of buying, and asking what was needed in order to get a tax break. ( asking what is needed does not constitute a tax fraud ) And then we have others who have stated that they bought their tractors with the intended purpose of farming.. etc. There was even a caveat added that if the gov't wanted to investigate.. they could.. and if it was proved that the farming operation didn't qualify.. that they would pay their tax and penality...

"Any one may so arrange his affairs that his taxes shall be as low as possible; he is not bound to choose that pattern which will best pay the Treasury; there is not even a patriotic duty to increase one's taxes."

I submit that there is nothing more protective of a democracy (or a republic) than concerned, informed citizens doing all they can to keep their government, whether state, federal, or local, from dipping its greedy hand in their pockets.

That's put pretty good.
Furthermore, there is no law against attempting to find a "loop hole" (for the sake of a better word) in the tax wording to somehow qualify for the deduction(s). This is common practice and most CPA's are up to snuff to help the individual find that. If there's a chance they qualify, even a remote one....something the CPA could argue....then he should advise his client to take advantage of it. Taxation of law abiding citizens is one of those burdens we carry. The problem with it, IMO, is we don't know or don't agree on how our tax dollars are spent...and we have no control of it other than to trust those we vote in to regulate it and that does not always work either. Look at all the welfare recipients and fraud that takes place. I surely don't want my tax dollars funding some bum or drug addict or criminal.

BTW finding "loop holes" is very common in civil and criminal cases. You see attorneys representing defendants and get them off on the stupidest (is that a word) things. They range from minor legal violations to heinous crimes and it happens all the time. You see it next door and on TV.
And IMO, there's a world of difference between those people and the average law abiding, tax paying citizen.

Related thoughts:

1. I do not automatically pay an income tax penalty. You know when I mis calculate my withholding or estimated payments by an amount greater than the "law allows" ... a penalty is due. My tax software generates a page for the penaly calculation that I'm supposed to file with my return. I file it in the shredder. If the IRS or state tax board want it bad enough, they'll bill me. Sometimes they have and I pay it promptly. Sometimes they haven't and I didn't.

2. In Kalifornia, (and several other states as I understand it) our SUT, Sales and Use Tax, code specifies that each resident is responsible to pay the State tax on goods that will be used, consumed, etc within the state ... no matter where they are purchased !!! So, anything purchased over the internet, mail order or in person outside the State, the SUT is "due" the State. The seller is not responsible to collect it, the buyer (the resident of California) is supposed to voluntarily make payment to the State Board of Equalization. I have never personally known of anyone that has paid the tax in such a situation. However, recently, there was a news report of a guy who bought a bunch of very expensive art work out of state and the State billed him for a pile of tax.

Homebrew, Interesting.. so say a person lived in CA.. drove out of state.. bought ? uh.. gas and a soda.. then drove back in state, and use dthat gas and drank that soda..? so they would have a tax liability in CA? Wow.. glad i don't live in the people's republic of kalifornia.

3RRL, you bring up a good point of our tax dollars being used to support all those deadbeats. I had jurry duty recently, and when they asked us if there was any reason we may need to get out of it.. someone replied that his tax dollars support many unemployed, or welfare recipients.. or criminals in jail.. and that he really needed to get to work because so many people were depending on him... ( got lots of chuckles.. though i couldn't see the judges face from where I was setting... )
