We decided about 4 years ago to buy some property from my grandmother and build a new house. From the beginning we ran into road block after road block. It took us 18 months to sell the old house. During that 18 months we started the process of buying the land. The surveyor determined that one of the adjacent landowners was encroaching and had taken about 1.5 acres. When we spoke to him he said he was sure of where his property lines were even though he didn't know where his survey markers were. It ended up going to court. The judge said that our deed was correct but my 86 year old grandmother should have known that he was on her property. It didn't matter to him that they both acknowledged in court that he leased part of her property for his cows. Anyway, the property had been in the Pepper family since 1857. That was over and we finally began construction on July 1st 2005. Where am I going with this? We moved in today!!!!!! /forums/images/graemlins/grin.gif

I will be posted a lot of pictures of the construction, particularly the dirt moving phase. I built a driveway through an area that you couldn't previously even walk through. That work was done with a 40hp Komatsu dozer, a Yanmar YM1500D tractor with loader and a John Deere Gator as a dump truck. Then I upgraded the tractor to a John Deere 4310.

This is what the house site looked like the first time we came out.

There is a creek that runs along beside the driveway and sometimes when it would rain, well the picture says it all. I fixed the bank of the creek.

Nice aerial shot. Look to the right of the bridge and you will see the driveway.

More pictures to come later.

I didn't understand what the final outcome was here. Did you get the 1 1/2 acres back, or did you lose it???

I see from that air photo that you also bought an air plane to go with your tractor /forums/images/graemlins/grin.gif We would like to know what happened to the property. Judges are something . Your 86 yr old grandmother should have known the neighbor was on 1.5 acers of her property. Never mind the guy was on her property, she should have known, GIVE ME A BREAK !!!! What if it were his or his 86 yr old grandmother's property ?I'll bet He would have a different outlook on the case.

Magic words here, "since 1857". Now your Judge looks even more silly to me.

One - I'd like to see the surveys from back yonder. Wonder if those trees, stone walls and rocks they probably used are still around?

Two - Like your GrandMother had something to do with it.

Grrrrrrrrrrrr....... this "Judge" just wasn't thinking clearly.

Finding boundry markers and matching today to days of yesteryear can be a real challenge, one will need to spend a lot of time in a courthouse, probably viewing microfiche.

I don't think Brents owns an airplane.....judging by the altitude....and what appears to be an approach vector of--hmmm....yes, and a lateral speed of, oh, zero...my guess would be a French-made Gazelle helicopter.
