Yeah, that attached part is a killer. I never understood that. Put up a deck, no permit, no raises in taxes, UNLESS, you attach it to the house, then UP goes your SQ footage and your taxes. /forums/images/graemlins/tongue.gif
Many people don't know that if you build it free standing, even if it is only 1/4 inch from the house, it adds nothing to the house.
Your patio is probalby different from a deck, though I wonder if it works the same way as for decks.
As for the depth over on this side of the line, I'll have to check, but still recall it being 32" or so when I put up our garage foundation that I set into the side of a hill about 12 years ago.
