There has to be another court that can have the review process, all the way to the US Supreme court if they choose to hear the appeal. I wouldn't take this lying down. There has to be a way, you just have to find it. How about suing the people that made the original error. The proof is on your side from what you have posted.

This goes back to my point that the property tax system is the root problem. Fix the property tax problem and the eminent domain issue can be brought back within constitutional limitations.

Cowboydoc - Have you appealed this to the state level? From your post it sounds like you have been dealing with your local tax assessors. I would appeal up to the next level like Junkman said and keep going until you have exhausted every possibility. If your attorney is not enthusiastic about doing this, find one who is. You can stress these local bureaucrats out to the point that they back off. They are counting on you to just give up at the first resistence from them. Don't make it easy for them. They probably look at you as some rich guy who has thousands of acres who can afford to pay more and they are by-god gonna make you pay if you don't fight back and be persistent until you win.

This seemed to be a public use thing rather than private use thing though. If it had been for private use he would have gotten a LOT less....still it seems even with the money he really did not want to move....

Yes, public use. But the common driver is eminent domain.

Make one wonder how the public will benefit once the everglades are returned to their natural state.

Perhaps the public will benefit from an improved water source. FL has been plagued with water shortages for many years, believe it or not. Actually it is not a water shortage issue, just a surplus population issue /forums/images/graemlins/smile.gif

That's one of the things that gets me about property taxes.
Renters get to vote me in higher taxes.

In CT property owners are allowed to vote on any ballot questions that will effect the property taxes in the town where the land is owned, even if they are not living in the town and are a registered voter in another town. If it has an effect on your property, you have a right to have a vote.
