I've been noticing it happening more now and more particularly on the right side. Should I be concerned? Is there a way to prevent that from happening? I saw the nut that can tighten the pivoting motion, however, I didn't think that would actually prevent contact.

My BX23 does the same thing. When traveling over uneven ground, the front axle will contact the frame on the underside. This is the travel limiter.
The pivot bolt has about 15 foot pounds of tightening torque, and you wouldn't want to tighten it enough to stop the pivot action.
