easements are always an explosive issue

For the life of me, I have no clue why anyone would consider buying a piece a property where a easement is in the mix. Just like a HOA, things may be ok for a couple years, but sooner or later if a issue pops up it will never be worth the headache to me to get involved with it in the first place.

Come to think of it, I'm up to 4 rules in life to live by...

Don't mess with a mans wife
Don't mess with a mans money
Don't mess with a mans dog
Don't buy anything that inlcudes an easement or HOA

Those rules are really only ONE rule!

If you mess with his wife, she will file for divorce. He will loose his wife, his real estate, and his money, and she will take the dog just for spite!.

Looked at some property a few years ago. An elderly couple neighbored the property, they were landlocked. They had used a road through the piece we looked at to access their property, and had been using it for 30 years. No easement, no documentation. A dang nice road, and they had maintained it for years. The lawyer/title company we were using said dont go near it - they would not ensure the title, and whomever bought it was asking for trouble. So, we moved on. Sure enough, I heard sometime later that there was a lawsuit involving the road and access.

Hah, I lived the experience. Real Estate laws have changed in time with disclosure information. At the time I purchased a property I was unaware of on-going easements and covenants being proposed. Those things are no longer allowed, at least in my state.

I bought property. A person bought property behind my property that was land locked by my property and another person's property.
The person that bought the land locked property didn't want to deal with the other property owner for access to his, so they asked me about buying property from me instead of me deeding them a legal easement.
I ended up selling them the property.

That is the best way to handle that situation.
Sell them the strip of land, redo the deeds and survey's and put up a fence.

No more hassle for you and easier to sell if you need to in the future.

Guy bought land behind my dad, wanted access to it down his barn lane and through his hay field. No was the obvious answer.

There is nothing wrong with reasonable easements. In California, the power company has an easement along power lines so they can do trimming which, in turn, prevents wildfires. No easement = a lot more fires. We have irrigation ditches that deliver water to us and neighbors. There is a 10 ft easement along the property boundary so people receiving the ditch water can do routine maintenance like unplugging a stoppage, etc. I've owned many properties with easements and they have all been ho-hum boring and not a problem at all.

An HOA, on the other hand, is sort of like the nuclear bomb of easements. If a few "leaders" get in power, it can be miserable for the rest.
