Help! I need legal advice re: easements

Just to make sure that I have the story right:

(1) This neighbor attacked (via the legal system) your builder during the building process, and was financially rewarded for the act.

(2) This same neighbor is now attacking you (via the legal system) for whatever reason(s).


As an outside observer, it would appear that if this guy wins in this controversy, the more likely he'll continue this trend of legal attacks. I believe that I would try hard to make it as expensive for him as possible (time and $$$ costs) in order to encourage him to avoid legal tangles with you in the future. But that is easy for me to say since I'm not in your shoes.

Is there another chapter in this saga yet? I've been following this thread for some time and I can't wait to see how it ends up. I just can't believe the nerve of some neighbors these days.

Ok Ok next chapter (I've just needed to not think about this for awhile)
In the last episode we left off with our hero (?) attending a mediation. Our hero (I think he needs a nickname, any suggestions?) expresed his opinion that the mediation was a bust in all regards.
We now join our embattled hero as he enters the court room with his expensive legal representation for a status conference with da judge.
The evil neighbor's attorney reports there was much progress with the mediation (!!!) (the hero barely subdues a rude outburst)
The hero's attorney says the mediation was a total failure.
Da judge say Ok go back for more mediation. (!!!)
So now we go back again with their lawyer, my lawyer and the mediation lawyer and my wallet. We were not even remotely close to any compromise so I see this as an absolute total waste of time and money.

Our legal system has been perverted. It no longer operates to solve problems. It is in the best interest of lawyers (who are also judges and legislators) to have whatever dispute continue for as long as possible and have every issue as complicated as possible to continue to require their services. We are choking on laws. Yes, my opinion is jaded.

I now put on my cast iron underware and crash helmet and wait for the response.
