I would suggest contacting a lawyer. The lawyer doesnt need to do much except give you advice. Best if you can find one via word of mouth.
I use a lawyer realatively often. I own a business and for the hundred bucks or so it costs me to ask an indepth question is well worth it.
I have a similar situation to yours. I have a horse on my property that I cant get off. Although in my case the owner owes me several thousand.
I have put alien on the horse, I am taking the owner to court, and I have the horse schedule for auction the date after the first court hearing so that the judge can give the auction his stamp of approval. If he denies it better now than later.
In your case, no boarder or pasture contract between you and the horse = trespassing. I personally would contact animal control to have it removed. I would use the words, neglected and abandoned.
Just dont remove the horse personally. Quite a few problems can arise from that. Especially if something happens to the horse.
