I have a couple of guns I'd like to sell and I have no idea how to go about it properly. I have never sold a gun before. I would like to know what I need to do to make it legal if I sell to another individual, which I would prefer to do, but I am also curious about which internet sites are best for selling a gun and some general info about how they work.

I know I can research this info but you TBN guys always have the necessary facts quick and easy.

Both of these guns are oddities so I doubt I'll be able to find a local individual who is interested without some form of advertising. I'd prefer not to sell to a local gun or pawn shop because I'm sure I'd take a beating on the price.

For reference the guns are 1) Ruger model 77 in .358 Winchester, light use, wood and fiberglass stocks, about 80 factory rounds and over 200 meticulous hand loads. It has a nice 4x Nikon that can be included if desired. 2) Remington 870 "Special Field" 12 ga. shotgun with a straight English walnut stock. Has some nicks and scratches in bluing.

Best to just turn it over to the government. :banghead:

I don't presume to know all state and fed laws, or where your buyer is located, or if you plan on mailing it to the buyer in another state; but I think if that even in the most strict states, if you arrange the sale between private parties, but have the transfer go through, (or mailed by) a dealer to another dealer, (probably some nominal (or not) fees required) you'd be legit.

Gunbroker.com is one way to advertise. Like ebay for firearms. If selling out of state you would have to ship through an FFL to the buyers FFL. Someone please correct me if I am wrong here.

mjw357 and CobyRupert have it right. Go through an FFL dealer. You can pass the shipping cost onto the buyer and the buyer would have to pay for the background check (if required) at the receiving end. You can estimate shipping costs going to Fed-Ex or UPS websites or ask the FFL.

You can sell personally to anyone in your home state that can "legally" own a firearm no paper work etc. If you cross state lines then you need to get the FFL involved. I would try to sell locally to a private party just require the buyer to have a drivers licence and or cwp! there is no need to get a FFL involved unless you sell across state lines.

Paperwork requirements vary significantly by state. In some states firearms can only be transferred by licensed brokers (the stricter ones), but most licensed folks will do the transaction for a fee, which is how you get around individual to individual sales or out of state sales at least in MA. I believe that there is a requirement that both the seller and buyer must comply with the requirements of the buyer's state of residency both to sell and purchase the firearm. For some states this can be really difficult (MA, CA, NY, etc), for others it can be extremely easy (VT, AK, TX, NH, etc). You might opt to go through a broker, who would be familiar with the requirements and be able to better facilitate a sale.

I just did my first transaction through GunBroker.com and it was wonderful at a very low cost. They have tutorials on numerous subjects to answer questions you may have. Remember laws are different from state to state and Federal FFL requirements are different for hand guns vs. long guns.

Personally, I would sell to an individual by word of mouth. I would never buy/sell a firearm that provided the government with a single iota of information. If you are comfortable the buyer is not criminally insane - that's good enough.
