Oh ok. I must missed a post or two.. didn't know that we were talking about a haul for commercial purposes.

Mine are all just for me.. non comercial, not for hire. I hear ya on the employee problem.

big difference if you the owner are doing everything, vs having a 'helper'.

heck.. anymore I cheat. i've painted index lines in red, orange, green and white paint on my trailer decks to corespond to different tractor / implement combinations... that way I can pull on till my fronts hit their respective color lines and know I'm pretty much loaded where I need to be for proper tounge weight.

With no signs or #'s on my truck, so far I've yet to ever be hassled by DOT, nor do I expect to be ( knock on wood ). I don't have a cdl, but then, I'm not commercial either.. no hire out.. just me moving my stuff to / from my properties. For a 'feel good' moment, I have taken my rig down to the cat scales at the interstate and weighed unloaded and loaded to make sure I was 26k or leass, and within trailer and truck ratings on my F450. So far.. unless I stick a pallate of wet sod or something like a smartcar on the front of the trailer.. I should be OK.. :)

Much will depend on local LEO's and their interpretation of applicable laws. Here in Kentucky, I know of several guys who are 110% NON-commercial. They were towing to either tractor pulls or tractor shows. Ky Commercial Vehicle Enforcement Officers ticketed them because it is considered "compensation" to win $100 at a tractor pull or a $2 trophy at a show...Therefore resulting in their being described as "commercial vehicles".....They went to court with lawyers in tow, and beat the citations, but were left with legal fees in excess of what the ticket would have been.

Plum ridiculous....

you know.. I've heard that argument as well. IE.. if you can win a cash prize, or 'like cash goods' then I've heard it twisted to be construed as commercial.

I don't do any pulling, so I'm safe there. I've yet to find a way for my antiques to make me any money.. :) ( saved me some.. I think.. maybee.. but havn't made any yet! )

Here if you are over a certain GVWR/GCWR you are commercial. Unless exempt like an RV.

I would think it is the same for you.

over 26k here you need a cdl. or if air brakes you need a cdl.

we have lots of rental trucks.. uhaul, etc, that are tagged 25999.

On any 1 ton truck or heavier the tags are renewed in december instead of your birthday, lust like it was a commercial tag.. but if you look at the registration, it shows as a non commercial passanger vehicle.

so far I've yet to see anything in florida that says if you own a gn trailer and 1 or 1.5ton truck, and just move your stuff, that you need a cdl.

used to have class D cdl's here.. mostly farm stuff.. but they did away with em.. now it's a-b-c or e.. c is 26k+ and commercial.

That is not the case.

The Devil is in the details. I would concern yourself with finding where it says that personal use is exempt from CDL otherwise it would be pretty safe to assume that it isn't. It really has nothing to do with the tags(registration).

The Devil is in the details. I would concern yourself with finding where it says that personal use is exempt from CDL otherwise it would be pretty safe to assume that it isn't. It really has nothing to do with the tags(registration).

Personal use is exempt from needing CDL in Ky, so long as below 26,000gvwr. Some still operate as if 26,000 restrictions don't apply. It's only a matter of time for them..... RV's are exempt.

Exemption goes out the window once you cross state lines with a trailer attached and GVWR over 10,000lbs. Except for RV's....

Where it's becoming muddy is what EXACTLY qualifies as "personal use". Many LEO's just cite you and make you prove to a judge you aren't commercial.

In the end, the letter of the law means less than the INTERPRETATION of the law by LEO's and judges. They aren't real big on debating the subject.

For just this once, I'm glad I'm getting old...and won't need to deal with this stuff much longer.

Of course it is because no CDL is required below 26k GVWR. There are exception of course, like busses and hazmat.

There is more to then just the trailer being over 10k GVWR as well. The CGVWR still has to be over 26k to requrie a CDL.

i'm refering to under 26k and personal use. That's what the local dot told me. under 26k, no air brakes, personal use/non comercial/not for hire, and your truck and trailer are tagged and legally capable ( gcvr ) of carrying the weight you got on them, then class e drivers license.

What is the GVWR of your truck and trailer. 26k means CGVWR not actual weight.

Again air brake makes no difference.
