I live in SC and am using much of my land for agricultural purposes and would like to figure out how to have it classified as such with the Tax Office. Can anyone give me some advice on how to begin this process?

I had to send an application in to the County Registrar to obtain a greenbelt tax rate in Tennessee. In the county, you just have to show sells of at least $1500 annually to maintain your tax rate. Just check with your local tax accessor and you should be able to get complete details.

Contact your county agent for local agency registration, your tax assesor to possibly have to change the zoning, the US Dept of Ag to register as a farm, the IRS to fill out whatever to call your "business" a farm, and get out there and FARM........God bless......Dennis

when I moved to the sticks 4 years ago in kansas the county changed my appraisal to a 60 acre residential lot!!! I just took pictures of the land and got a letter from the farmer that hays it for me and set up an appointment with the appraiser. I went in prepared for a battle and she just looked at my pics and changed it. The whole thing lasted about 2 minutes.

It's called current use classification in my neck of the woods. One small piece for the house may be residential but the rest is classed timberland.

You really need to check the SC rules/laws. The county extension office should be able to help you and very likely the information is on the web.

For what it is worth most of our land is under a timber valuation. I had to show that we had or planned to timber the property, produce a map showing timber types and location, roads, trails, etc. Not real hard to do since we had timbered the property and had already made money. :) I also had to create a timber management plan.

The state Forestry department will do this but there is a wait time for them to do the work. I talked the local Forester and was not impressed with his attitude so I did my own d....ed plan. :D The NEW state Forester seems to have his act and attitude right but it would still take time for them to do the plan so you have to start well before the valuation deadlines. None of the above is hard, information on what to do was on the web and available from the extension office.

The extension office had a meeting over timber, Ag, and wildlife land valuations late last year. The state is going to be reviewing some of the older valuations to verify they are still valid. The first part of the meeting was a bit tense since we did not know what the state/county was up too.:eek::laughing: We thought maybe the rules were getting changed and we were going to get the shaft. :mad:

Right after we bought our land it was time for the county to evaluate property values. At the time the county was doing evaluations every seven years. Our property values went up FIVE time, 500%. Without a timber valuation we would have had to quite a bit of the land which is ironic since many people in the county, especially the county government are against development. Their property tax would have forced us to sell and given we are in a prime location they land would have sprouted houses. Just what the county does not want. :mur: :confused3:

But we were able to get a timber valuation and all is good. :thumbsup: :dance1:

I would not delay on getting in touch with the County.

In my county, Travis, (and state in general, TX) they have been tightening up the rules on Ag exemption for property taxes. If you live on the property, automatically the house and 1 arce is zoned residential.

If you have the exemption, you are good. New applications are being reviewed carefully--there were too many people abusing it--people with 20 arces a 5000 sq ft house and 1 cow. Now there is a formula depending on your activity (hay, argiculture, live stock), plus there is a 5 year process where you have tio provide receipts, etc to get and maintain the exemption (after the five years, no annual demonstration is necessary).

Also, if for some reason you ever lose your exemption, the county can retroactively hit for the last 5 years of taxes.

I have quite a bit of high transmission lines going through the property and also county road right of way. This acreage is taken off my property tax acre for acre. I had to inform them of the right of way to start with. We also have some wet lands that are classified lower than the timber land. I had to request that also. The homestead exemption was mentioned above and we have to apply for that also.

"wet lands" can be a bummer if you want to do any improvements.

Or an "Indiana Bat Tree" where we used to live. I grew so weary of the city and county regulations that we moved four years ago. It took me a year to get a building permit for a pole barn where we used to live. No building permit for a barn is required where we live now.
