A man walking along a California beach was deep in prayer. Suddenly the sky clouded above his head and in a booming voice the Lord said, "Because you have TRIED to be faithful to me in all ways, I will grant you one wish."

The Lord said, "Your request is very materialistic. Think of the enormous challenges for that kind of undertaking. The supports required to reach the bottom of the Pacific! The concrete and steel it would take! It will nearly exhaust several natural resources. I can do it, but it is hard for me to justify your desire for worldly things. Take a little more time and think of something else."

The man thought about it for a long time. Finally he said, "Lord, I wish that I could understand my wife! I want to know how she feels inside, what she's thinking when she gives me the silent treatment, why she cries, what she means when she says 'nothing's wrong', and how I can make the woman truly happy."

The Lord replied, "You want four lanes or six lanes on that bridge?"

In Rhode Island, there are two restaurants side by side once owned by a married couple (Beef Barn and Coffee and Cream, in Smithfield I think). The couple gets divorced. Husband gets Beef Barn; Wife gets Coffee and Cream. Divorce agreement says they CANNOT be opened at the same time. (C&C for breakfast/B&B for dinner)

That's what the locals say anyway!

It might not be such an easy case. What if the property was not inside of an incorporated city, and the property was completely owned by him? If that were the case, then you would have to prove that he endangered somebody elses' person or property. Now since the Fire Dept responded, and he was holding a gun, you can show that somebody could have been endangered. Only bringing this up for fun conversation. I was an Arson Investigator for 3 years, and the "what if" thing is always open for opinion...like Bird, I spent almost 30 years seeing this kind of stuff. It always amazed me at how strange it could get.

Big Mike, you are right, ...but..., the reason he is burning the house is because his wife will not get it, therefore I assumed it to be not entirely his but joint property, however if he owned it before he got married and they did not do anything or add anything or spend any money on its upkeep, and he was outside an incorporated city limits, not insured, and a judge had not already given the house to the wife, then he might slide by with "terroristic threat" - if he place any person in fear of imminent serious bodily injury; or "Assault" - intentionally or knowingly threatens another with imminent bodily injury, which he did to the firemen, (If they weren't threatened why couldn't they do their job?) and also if any item of the wife's was in the trailer, or any item they bought while they were married and was in the trailer he could also be charged with "Criminal Mischief" - he intentionally or knowingly damages or destroys the tangible property of the owner. I don't think he was smart enough to consider all these things. I am also bringing this up for the fun of it because it just seems like he should be arrested for something for not being nice to the firemen.

But don't forget, this supposedly happened in Tennessee. By burning his trailer, regardless of who's property was inside, his only offense may have been 'performing capital improvements without a permit' /forums/images/graemlins/grin.gif Just kidding, I have been to Tennessee a couple of times and I don't think I have seen a prettier place. Us Texans are just full of ourselves.

The trailer that was burned down is in Nash county, NC. There was another blurb in the paper today saying there was no lien on the place so there where no charges to be filed.,

To file charges on the home, the statue is for the "dwelling house" of another. Since it was his house.... And since there was no lien it was his and the wifes.

She could go after personal property but the material goods where bought after the marriage it is his as well. If there was insurance on the house or property then he could be charged. Since he was not charged it does not look like he had insurance.

I suppose she could go to civil court about some of this but criminal charges don't seem to apply from my quick look and memory of the NC statutes. One would think he could be charged with something...

I don't believe having insurance on the home would matter, unless he were to put a claim into the insurance company for the loss. If the house were jointly owned, then the wife could put in a claim and the insurance company might pay and prosecute or just deny the claim since the fire was a result of a spouse.
