I\'m going to court this week
Friday I got a fax from my attorney who was served notice of a motion to issue a temporary restraining order enjoining me from a laundry list of things all related to trespassing. Interestingly enough, the property on which I'm supposedly trespassing is MINE! It also requests a hearing immediately to get a permanent restraining order.
The party from whom I bought it has either forgotten I bought it over two years ago OR failed to tell the woman who is essentially the complaining witness to my "transgressions."
My attorney was going to call the counsel for the other side and suggest they do their homework, but I told him not to do that. I think it'll be more fun to "violate" the TRO daily until the hearing, listen to all the "evidence" and then, and only then, produce my duly recorded deed and certified survey and property tax receipts and just embarrass the hell out of them in front of the judge.
At that time I intend to ask, since we're all here about a restraining order anyhow, could I get one to keep them off my property since the complaining witness talked about what was in the bed of my dump truck and that could ONLY be seen by trespassing on my land and climbing on my truck.
Hell, I'm 6'-8 and can't see over those sides from the ground. Someone 6' cannot even see over the tailgate, which is closed.
