Just a bit of a digression and diversion.....

If you disagree with a disagreement, aren't you really agreeing? I think english teachers call that a double-negative. Something I picked up after a good knuckle-whacking in grammar school. My fingers curl up involuntarily everytime I run across one of those double-thingies or a dangling participle /w3tcompact/icons/clever.gif

One of my pet peaves is when someone asks "Can I go with?" With what? With rollers in your hair? with a big stain on your shirt? with what do you want to go?

My kids have picked up this saying off of TV and I never let them get away with it. My english teachers never wacked my knuckles for using dangling participles but they seemed to enjoy using that big red pen. But as you say, we digress.

Well hell I'll let the dog out of the box, I work for the Federal Government in the Construction Contracting arena had have done so for over 20 years. We inforce OSHA daily. OSHA does not apply to home owned equiptment used by the home owner. OSHA is designed to protect the worker on a specific type project. Now if you are hiring people to use your equiptment on your property then OSHA would apply. Say they pick up a chain saw to cut wood, well all the safety restrictions apply, face mask, gloves, ear protectors, ETC. In fact day workers would be your serious concern if they use any type of equiptment. Most of your home owner insurance has coverage for injury but you have to be very careful when you hire day workers. My policy is not to let them use any type of power equiptment or drive my truck. OSHA can come in and fine the hell out of you, even on your own property if there is an incident with a worker or in fact they see someone working. They have full search right's to enter property and check on workers safety, more so than the police in some cases. If it's just you the results would be, O'well so sad, sorry. You should have been more careful.

You hit the "10-ring," Pitbull. I run an elderly 5-wheel 'Gator that 4 or 5 employees and customers use around my horse operation. I checked each user out on their 1st experience and again a day or two later to make sure they retained the specifics of my instructions. I still had them sign a 'Hold Harmless' agreement for 'Gator operation. To date, only going too fast and overloading the dump box have been operating violations. I made each of them read the 'Gator ops docs in the beginning. I think it is easy to forget that these vehicles have unique operating characteristics and enough speed to warrant special instruction and follow-up by the owner. Long live the 'Gate and the operator and bystanders!

I too work to enforce OSHA standards at my job. It is a good idea, if you as a private homeowner, do your best to familiarize anyone you hire out to work at your home with your equipment that they use. No one wants an employee to get hurt, even if they are a total stranger that you have hired for the day, BUT, here comes the BUT. OSHA requirements are only for businesses of certain sizes. You have to have so many employees, I believe it is 10. We don't have to worry about that, we have 7000, we know we fall under it. It gets more complicated than just familiarizing or training someone on the equipment. There are multiple steps. The training. The proficiency exam, and the records. Not only do you have to train them but you have to give them a hands on test and then you have to keep records showing that you did all this. And to do all this, YOU have to be certified. If you as a homeowner see a guy holding a sign that says "Will work for food" and you take him home and he works for you, OSHA holds no jurisdiction over you.

Just to clarify,

(a) Each employer -- 29 USC 654.

(1) shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees;

(2) shall comply with occupational safety and health standards promulgated under this Act.

There is no mention of number of employees.

OSHA guys are one thing (and generally okay), but I think we should start a list of any members who do not post between April 15, and say, May 15. We might want to simply assume they are IRS agents just to be on the safe side. /w3tcompact/icons/wink.gif

LOL! BigPete, you may notice that a lot of memebers will not be posting on that date as they are so pissed they have to send away enough money to buy another implement, that they are sitting there thinking about it.
