I was reading the February issue of "Farm Equipment" and there is an article titled "Deere wins grey market ruling"
John Deere won a preliminary ruling before the International Trade Commision to prevent import and US sales of tractors and other equipment bearing the company's trademark green and-yellow color scheme.
The ruling resolves two seperate matters in favor of Deere.Foreign exporters and US importers and retailers were found to be infringing Deere's trademark by selling "grey market" goods in the U.S.,specifically manufactured for the European Market.
Those goods although actual John Deere equipment,were made for European standards and safety regulations.Second,Chinese manufacturers and their U.S. importers and retailers agreed to stop tractors with green bodies and yellow wheels and trim in the U.S. under an ITC approved consent order.
The ruling could affect more than two dozen American importers and foreign exporters.It will go into effect April 13 unless the six commisoners alter the judges ruling,according to the ITC.

So that would mean a John Deere, painted green and yellow by John Deere, but made in a European plant could not be imported into the US if it's still green and yellow??

But maybe that ruling will stop importers of some Japanese tractors from painting them with that scheme, for whatever reason they do.

I doubt it could stop them. Kubota went through this a few years ago and they went with the trademark infringement route. Now Wallace importing out of California is buying Kubotas with Zen Noh decals on them and importing them and he has copywrited the name Zen Noh which is a Japanese Co-op. The dealers that repaint their tractor for whatever reason when the tractors get here will be harder to track down.
