What it all comes down to is insurance. Some areas and companies will not touch such weights without a CDL.

I'm lucky enough to live where I can do pretty much anything.

Problem solved. Having the trailer de-rated from the manufacturer.
Pro's
I have enough capacity (and length)to carry what I need without going over the GVWR on the manufacturers tag.
I do not need a CDL because my gross GVWR will be under 26000.
Cons
I can never have the trailer re-rated to full GVWR. (At least as far as I can find out)
That might give me a problem if I ever wanted to sell the trailer.

I do not want a CDL. It is not feasible for me. To many hoops and restrictions because my tractor is a few hundred pounds to heavy for a certain trailer.
I mentioned that I was once a CDL driver. I kept the license for many years when I no longer needed it but when the company I work for found out I had a CDL they began abusing the knowledge. When their CDL drivers, who were compensated for their license and their license was required for their job were unavailable, they would call me to drive a truck or something of that sort. I have a desk job. I didn't want to drive their truck so I gave up my license.

Yes actually I do think I can get in an 18 wheeler with my own personnel stuff " not for hire" and go any place I want. Not that I have a reason or enough stuff for it to make sense but I can if I want.

Here it is. I knew I saw a weight limit for farm tags with non CDL. https://www.txdps.state.tx.us/cve/Farm.htm

A vehicle owner may obtain a "FARM TRAILER" license plate for a farm trailer or farm semitrailer with a gross of more than 4,000 pounds but not more than 34,000 pounds.
....................also for farm truck tags............
May not use a vehicle with a "FARM TRUCK" license plate to tow a trailer with a "TOKEN TRAILER" license plate.

There are no hoops to jump through for CDL with the restrictions I have.......no air brakes....... custom harvesting interstate. I don't need medical and don't have to do daily inspections of the vehicle if is my only "rig".
Only bad thing is I can not renew online. I have to do it in person.

Well the actual order to the manufacturer went in today. I have time (4 to 6 weeks) to change my mind about the license. All it takes is a phone call to the manufacture to raise the weight.

The way I look at it..........I got the CDL and if stopped..........I only have vehicle violations or overweight. No grey area by the officer if I have the right license or not.

I can't see buying a trailer and under rating it. It's like buying a long bed foot pickup and only use it as a short bed pickup.

I think you made the right choice. That is what I would do. What is your pickup GVWR? Mine is 10k. I would get it rated at 16,000 to put me right at the limit. If you have a one ton your truck GVWR is likely higher and you would need to lower the trailer.

these number still put me over my gcwr

don't care no more. I see 25900lb 40 foot goosenecks all the time behind 3/4 ton pickups.

Sounds like a good plan. Unless you just need that extra 700lb I might just go with 16k because a lot of trucks are rated at 10k these days and if you ever sell your potential buyer will likely be pushed over 26 with a 16700 trailer.

If you have unanswered questions or are unsure of the regs call the DPS office in Lubbock at 472-2800 and ask to speak to someone in license and weights. When I first got my DOT number they were very helpful explaining things to me I even went down there and met with a guy and he spent 30 minutes answering my questions.
