Sometimes you can be DEAD right, and be just as DEAD if you were wrong. Sometimes even lawyers and courts make or hand down decisions that are not fair. I drive a route every day on my home. There is a very sharp curve, then a straight away that you can see about a mile down the road. But just as you come out from the curve( about 1/4 mi) as people are pouring on the coal from making the curve, there is a county road to the left with a yellow line. I always signal far in advance before turning but about once a week some a hole will pass as I am trying to turn. Thats why I always look when turning left and yield to stupid people. If the other people dont presue it, you might be better off just biteing the bullet and fix your own UTV. A lawyer can get very expensive, fast. I dont want to get on on another tangent but many times the law is just what a judge and another lawyer wants to make it. If it is the law, then there is not alot of argument left. I am not a lawyer by any means but in our area there are alot of Amish with their buggies. If there is a yellow line and even you can see 5 miles down the road and you pass it , even if the horse stopped to take a crap , you passed and had a accident, I imagine you would be in some kind ot trouble or liability. You would think common sense would prevail sometimes. Take for example, a Amish buggy pulls up to a stop light and it wont set off the sensor to turn the light green. (I have sat there sometimes for 15 minutes.) Finally my common sense kicks in and I wait for a clearing and pass the buggy and run the light. Braking the law, twice, crossing a yellow line and running a red light.
