Hot coffee and (near) boiling coffee are two different things. There are actual industry standards for what temperature hot coffee should be served at. I even recall seeing large urns with temperature gauges on them. I remember reading a medical discussion of her case. It basically said that if Mickey D's had served the coffee at the industry standard temperature, she would not have been severely injured. The injuries resulted from the extra hot liquid.

I can back this up with my own experience. When I was in the military, I managed to spill a cup of hot water that I had drawn seconds before from the hot water side of a cafeteria coffee urn. It went down my boot and was trapped against my foot by the wool socks I was wearing. I received second degree burns. I distinctly remember the doctor saying that if the water had been any hotter, I would have had third degree burns and would probably had serious tendon damage.

Fortunately, the damage was limited to pain, inconvenience, and embarrassment. /forums/images/graemlins/blush.gif

I did not see anything in the second link that was different than what I said.

But the point is, lawyers will drag everyone even remotely involved just to try to add to the bottom line. In this case, they obviously knew they would get nothing from those committing the crime (driver, coyotes, and immigrants themselves), so they go after the trailer manufacturer and leasing company.
I recently had to testify in 2 depositions and sit in on 3 others involving the company I work for as an "expert". The lawyers would pull single sentences out of a large document and attempt to make the company look guilty. But when I countered with other sentences that supported the company, he said I could not take something like that out of context. We had many very lively discussions about what he could do and what he said I could not do. Several times he got red in the face and called a break. It was a real eye opening and educational experience.
Guilty parties should be liable and responsible for their faults. But lawyers should not be allowed to drag anyone into the fray without first providing reasonable cause and having that ruled on by a judge or grand jury. You and I and everyone else are just a step away from being there ourselves.

So if you are over 18 you do not have to wear a seatbelt ? Or are persons riding in the back of a pickup not passengers ?

I am not saying the the law is properly enforced. I see people speeding every day, does that mean it is legal ?

I'm reading it as saying everyone under 18 has to be restrained but otherwise __________. What all is OK do to in that blank? Sounds to me like adults don't need to be restrained in either the cab nor in the back.
