found out today that surveyers were here to mark trees on the forest land adjacent to me. the last cut was 30-35 years ago so i guess the trees are mature enough now to take them to market. i am really upset because the trees are beautiful fir and cedar and they protect us from the strong north and east winds year round as well as runoff and prvide alot of privacy. not to mention we use the trails in the woods all the time for hiking and horseback riding. it's irritating because they own roughly 20,000 acres of land and there are many other areas they could harvest before taking these. don't get me wrong i am not against logging but this time it's too close for comfort! :) so i am looking for ways (legally) to deter them from moving forward. luckily they are not planning on doing the work until next summer (2013) so i have some time to formulate a plan! does anyone have ideas on how to handle this, is there any upside to this? looking for any advice you can provide or personal experiences with this type of event.

You are wanting to stop an adjacent landowner from harvesting the timber on his own land? You could offer him several hundred thousand dollars to just leave them. I'm curious as to why you want the adjacent land owner to loose a huge amount of money so that you can enjoy the view.

Buy the land and pay the taxes every year...

I hear that in this area all the time. "I moved here for the open space and now Mr. X wants to build houses next to me. Stop him !

Do you have permission to use the (private) forest for hiking and horseback riding, or are you trespassing in your endeavors?

Or is it national or state forest land which is being logged via contract/bid by private logging company? If it is public (state or federal) then the guvment is going to make $$$ from the logging, plus it provides jobs to your local economy...

no sympathy huh. trust me i get it, i just don't like it. my main concern is how the runoff will affect my land as i am on the downhill side of this section. also it's privately owned by a company in NH and managed locally. no i am not trespassing - they allow day use of the non motorized type and we are not doing anything illegal on their property, in fact they encourage use because it helps keep the riffraff out.

On a much smaller scale, my neighbor was clearing his 2.5 acres, and was looking at the fence line between us. I had the same thoughts, and had told the previous owner "if" he ever went to sell it, call me. I saw a for sale sign, called immediately, but they had decided not to sell it. I had my Mother call them from the other side of town, different last name on caller I.D. and she got the same story. Anyway, six months later, I saw some guys with a machette in one hand and a beer in the other walking the property. I inquired, and they were checking out the property for the new owner. Previous owner sold it without even giving me a chance at it. The new neighbor was clear cutting it, didn't like trees, to build a house. I got him to leave a line of trees along the property line to help block the wind, but in reality the small amount he left isn't going to stop much like before. Oh well, life goes on. Do miss not being able to see any houses except my mother in laws, till they cleared that lot, now I see the whole neighborhood.

You have enjoyed you're neighbours property free of charge, and now seek to engage legal means to prevent him from using his property?

I have several properties and run into this sort of "mental ownership" all the time, I even spent a few hours in the local lockup once because I came upon a guy with a chainsaw that was clearing a sight line on my property for better satellite reception and I gave him an old time lesson in property rights.
I've had the same policy for years, if you have a beef with what I'm doing on my property, make an offer or let it go. One of the biggest problems with the country today is the assumed entitlement to what others have worked hard for.

Contact the company in NH and have chat,maybe deal can be work out.

legally way you just might be lose your freedom to enjoy the land in the long run.

Most logging Companies and foresters are required by State regulations to protect the local watershed areas such as creeks;etc from runoff. Are those 20,000 acres being replanted? Since your profile states that you have six acres, perhaps you can build a berm on a comparatively small scale to help prevent excessive run off? On the other hand, I find it reprehensive that you have even considered using legal tactics to prevent another landowner for utilizing the use of their own land. I understand that you probably purchased your land and building site for your own "Camelot", but it is inconceivable that you think that you have the right to tell another landowner what to do with their own property. You should feel blessed that you don't live in an apartment complex with hundreds of neighbors and only have a wall that separates you from your neighbors. Hopefully the zoning laws won't be changed in regards to the adjoining property, and you won't have to contend with a large shopping center or Walmart. .:D
