Buy his land and pay the taxes or move if it really bothers you. We had a 3000 acre parcel up here and the people who thought they were in titled to use it and " protect" it with no equity involved were everywhere. As soon as it was made apparent to them that it would cost them money to protest, many disappeared.

Bigballer,
I just re-read your post on this issue and you have some nerve to try to stop some one from using their property the way they like.
I will say life isn't always fair! deal with it!
As i see it you have two options here:
#1, buy the property,
#2, shut up! and get on with your life!
If this were my property, you can bet your shinny dollar i'de be clear cutting within state rules if there were any and could care less what neighbors said about my decission.
People say, "I don't object to logging, to land fills, to trucking . . .as long as i don't have to see it!" I am a trucker by profession and a logger/ farmer for many years. In fact a trucker for 32 years and farmer/ logger from day one. I am proud to say I was born into it. Face it man if you take the loggers, farmers, landfills and truckers out you are "SOL" case closed! With an attitude like you present, maybe, and just may be you will be blessed with a BIG, STINKY, DUSTY LANDFILL! LOG-IT HARD BABY!. . .John

I understand how you feel, but as others have stated (with varying levels of diplomacy) you can't really complain about how someone else uses their land as long as it's a legal form of land use. Now, if the other landowner was doing something illegal, or something not allowed by zoning or covenants, then you would have every right to protest or fight it -- that's what laws and zoning regulations are for.

As an example, in my local area, a church moved into a residential zoned area and existed peacefully alongside neighbors for a decade. Then a new head pastor decided he wanted a mausoleum, about 35 feet high and 14,000 square feet, made of black marble. Neighbors successfully defeated that because it was not consistent with local zoning laws for residential. And I agree with that 100%. I'd expect the same if I tried to build a coal plant on my residential property, for example.

In your case, the logging company will be responsible for erosion and sedimentation control, and that could result in them stopping short of the property line when clear-cutting, but there are many ways to deal with that issue. As a responsible land owner, I recommend you follow the project/plans as much as possible, just to make sure they stay on their side of the line and don't cause runoff problems for your property. In my state, timber harvesting activity requires posting of a bond for this specific reason. If the loggers do something that ends up causing erosion or sedimentation issues on adjacent properties, the county has an automatic funding path to correct the issue on the logger's dime.

Bigballer, they are really beating up on you, I just wonder what they would be saying if someone was doing something next to them that they didn't like. It is real easy to "talk" but when it comes to them it is different. people on TBN do not see anything wrong about the shale gas drilling or the pipe line through Nebraska. But that is because it is not in their back yard.

Please do not presume to know what any of us would or would not do in any given situation.

If you find the TBN members such an uninformed and nearsighted lot, why are you even associating with us?

Exactly, and we all read it?

Some of the large logging companies around here will let you buy the standing wood in a buffer zone around your property (usually a camp) or some will even leave one as a seed reservoir if they were planning a patch cut. The foresters are people too and usually like to keep good public relations.

Preventing them from cutting the whole thing ain't gonna happen. We've had something like 10,000 acres cut behind us that hadn't been touched since pre WW2. The flooding from runoff is a bit worse now but it is regrowing quickly. They did some strip cuts and patch cuts, but mostly clearcut. They left buffers around the streams and swamps.

On the plus side, what used to be a 45 min snowmobile ride to the local hunting camp is now a 3 min car ride. Good for the old guys.

All I can say to this is "Wow". :confused2: Did you overdose on the Wheaties this morning?

When we logged part of our land one of our busy body neighbors called 911 on the loggers.

Buffoons. The deputy likely had a good, long talk with his high school buddies he had not seen in a while.

The "neighbors", I never did find out who called, but only about four houses are next to our land. I would bet they were NOT the ones that called.

They were danged lucky WE bought the land. There were games afoot to prevent us from buying. If we had not purchased the land it would have been clear cut just like the land to our west.

They then tried to say the loggers could not use a PUBLIC road. Dip Sticks.

Later,
Dan

Perhaps not all hope has been extinguished and the future might possibly show a glimmer of hope? Walk the adjoining property, preferably during nightime hours. Do your best in finding an endangered species on the land. An endangered type or species, such as a "BEETLE" would suffice. Then take your complaint to either or both of these organizations: (1) American Civil Liberties Union - ACLU; (2) People for the Ethical Treatment of Animals - PETA. :D

Wow, such a passionate debate!

I about to go thru something similar on a smaller scale. 2 property owners on my south side got together and joined their surplus land to form a 6 lot subdivision on a cul de sac.

Really sucks for me but not a whole lot I can do about it. In fact they may be able to do something about my now hidden hillbilly operation back there. New homes will be close to the line and that's where I keep all my utility stuff, tractors and implements, trailers etc. they will be on tiny lots with a view of my "junk". So I'm expecting I will at least have to put up a fence or worse move some stuff.

But OP raised at least one concern that is legitimate, the water run off. They can not increase the run off onto his property and should put measures in place to avoid that from happening. He could talk to county officials just make his concerns known, they may require the land owner to leave a buffer to lessen the impact.

In my case they required the developer to leave a 75' buffer to the rear of the project where it impacts another neighborhood, but nothing on my line. This will be a clear cut operation on about 3 acres :(
My run off now goes across their property so they have to install storm water catch basin to control it, they can't stop my water from crossing the line.

Riparian rights is a term from old common law that dictates some of these water issues.
