Now now boys let's not pee in each others cheerios. You are both right as you are both from different states. Here in Taxachusetts if you go with in 200' of a river or stream you had better have a permit from the state and local Gov.

I served on the local conservation board for years trying to help owners get what needed to be done done but it also had to be approved by the state in many cases and between the two could become very costly and time consuming.

I have hunted in FL for pigs with local ranchers on swamp buggies I guess you would call them that could run over trees 4-5" round trying to flush them out. This would be in fields and swamps and the first time I when on one of these hunts all I could say to the driver was that if we were back home he would be getting free meals very day in jail. We also have hunted out in the Everglades and stayed at his camp on and island there. Again we road out in airboats and a very large track machine that if you did the same here you would go broke paying the fines.

I would strongly suggest that the OP look into his LOCAL and STATE regs. before doing any kind of work near any water way. This is not to say I am in favor of all these regs. I just hate to see anyone get in trouble for it. By the way the E P A just passed a rule that they can fine anyone in these United States of ours and garnish your wages and set fines for any infraction of THEIR rule and regs. And yes that will include you lucky guys in FL. look it up before they get you.

Here in GA it is 50' for "construction" equipment...agriculture equipment gets a free ride...
Also there are provisions that say a person or persons can not be denied access to their property and in many instances the only access to a property is by driving through waterways (fords)...
It is not uncommon for the DNR to use our fords (on private lands) to access adjacent NFS lands...

I do.

Nobody wants to ruin our children's future. But you know the permit process has gotten absurd from your experience. If government agencies don't keep adding layers of regulation and ambiguities, they cannot keep growing their departments and increasing their budget.
It is the worst on the West and East coast, but has moved rapidly to the rest of us. The EPA is the most overreaching of all of them.
Oh well, just leave the rocks in the stream.

No matter what your anecdotal experience may be, there is no place in the US that personal property rights trump State or Federal law. Not one single place. You may think it does, you may have done things on your property in violation of State or Federal law and gotten away with it, but State and Federal laws come before your personal property rights.

You can't use your property to dispose of hazardous chemicals just because you want to, you can't own a slave to pick your crops, you can't legally pump water from the river or pull gravel out with out a water right or mining permit.

Georgia, Washington, or the Socialist State of California - State and Federal laws trump your personal property rights each and every time.

I think the price of gravel has more to do with mileage than digging it out/processing. From what I understand, a nearest quarry is rather far.

I have two each, 22 ton loads of slag millings coming out on 7/28/14. I am being charged $22 ton for the slag and $60 to deliver ~ 40 miles and he will be tailgating the load as he dumps it 10' wide. Owner/driver says I most likely will not have to do anything with the tractor to spread/smooth once he is through dumping my driveway :)

being down stream of some neighbors, one more specifically..... leaving dead cows, pigs, sheep, rotting directly in the streams, to having a lava flow in essence of pea and poo going across yard and into ditches... ma's house, lives in town on a lake, and when new development happens, you can see the silt and crud just coming into the drainage culvert that goes into the lake. from my own dealings with wash outs on hills and like. to dealing with flood gates for livestock on a stream that crosses pasture. to dealing with overflows on a couple lakes here on farm, and water ways in fields that lead to the lakes.

soil erosion is a big problem. being upstream, and not seeing what actually happens downstream. *arghs* and not actually seeing basic water test results *arghs*

a lot of damage can happen quickly without even realizing it. more so if ya don't know any better.

What you have described, boggen, is in violation of the Clean Water Act promulgated by the Federal EPA (yes, the same overreaching EPA some have bemoaned in this thread) and administered by the Illinois State EPA.

I'd take some pictures and file a complaint with the State EPA to get some action if I were you.

We have a "neighbor" about four miles down the county road that keeps 40-50 head of cows on his property. This operation is just like a small version of the Omaha stock yards. Everything those cows produce runs overland - and into the roadside ditch along the county road. The odor is so obnoxious as you drive by his place - I swear, it can cause instant rust on your vehicle. Well, nothing anybody could say or do would change his operation. Last year during the spring rainy season this roadside mess ran thru a culvert under the road and into a National Wildlife Refuge (Turnbull NWR). WoW & Holy Smokes - the Wrath of God and several federal agencies descended upon him and his operation. Now he has diversion channels and small holding ponds and things have improved dramatically.

One instance where Federal enforcement worked.
