Threads like these have a value beyond merely advising the OP on his individual issue. They can be a warning to others about what they could get into with a poorly worded deed that includes an easement or ROW. Even a well worded deed can pose problems if it involves a party who doesn't respect it. People need to become aware of the problems that lurk with rural property, easements, fences, neighbors and ROW issues.

A long time ago, we had an easement posting go way long with dire consequences for the op. Of course we only got one side of the story but it was great in detail.

I believe you have a legitimate issue, and your effort to seek opinions here was wise and has been beneficial. Good luck with your pole barn and channeling your time into a more productive direction. And please post pictures of the build process for your new barn!!

Thats why I came here looking for advice and suggestions. Good thing I did as most of you taught me things about ROWs. I could have just told everyone I will do it my way.....but everyone's input made my decision to not pursue this any further easier !

I have all the materials here just waiting for the Morton Builders to get caught up with other job, should start late next week. Oh...there will be pictures !!

No I didn't read the entire thread, I didn't need to. Do you know for sure he didn't talk to the other owner that you purchased the property from and had his permission first. What about ALL the other owners involved past or present that might have said yes to the work.
Somewhere there should be a ROW description, start to stop and marked as such. across the entire developed area. Otherwise the ROW could be anywhere or go anywhere inside the development.
The original developer should have this. It should also describe what is allowed and what isn't inside the ROW.

I wouldn't purchase land without a solid easement, ROW that is spelled out to a T.
I'm betting the guy knows what he can and can't do.

We called the other owners and asked if he had contacted them...all said no.

The ROW is marked on the Plat survery...50 ' ROW from center line of road. There is no rules or restrictions in everybody's Deed. Just the ROW was for exit and entrance to individual property's.

Some lighthearted info. I am not a pilot ! I retired from United Airlines last year after 27 years as a aircraft mechanic. My last 10 years were spent taxing airplanes and doing high power runups at Chicago O'Hare airport. Moving planes to and from the hangar and various terminals. Plus some of the foreign carriers. The 747 was the crown jewel to taxi. Hence my TBN name of 747 driver !!
