Before you do anything, GET LEGAL ADVICE. Don't be such a cheapskate. Pay an attorney now and you may save a lot more in the long run. Find an attorney that is an expert in real estate and riparian rights law, not one of those ambulance chasers that wants to antagonize and make everything a contest. You need to know your legal rights and, of course, what potential rights your neighbor has. Tell the attorney up front your most desireable scenerio: want him off your property, willing to live with a lease, temporary agreement, etc. Make sure the attorney knows you want to maintain an amicable relationship with the neighbor (I assume you do). Listen to his advice, then decide what action you will take.
Most of the posts in this thread are full of good advice as far as it goes. As my friend and attorney always says, "It depends..." It depends on what outcome you are seeking and the applicable law of the state you are in; and you need to know how to get those results legally so it doesn't cost you more than its worth later on.
