Our driveway is 1/3 mile that runs its full distance across a neighbors property. We have deeded right of way to use and maintain this road. Our South Western neighbor runs cattle on his adjacent parcel and also uses the road for access to his fields. He doesn't have written ROW but is a long time friend of the owners and has used the road when it was only a rutted track through the field. Both the owners and the neighbor are great people and are more than happy to take time out of their day to help you or just stop by and talk. The problem stems from our Village Idiot, err the the other neighbor. His property is about halfway down our driveway. His property corner is clearly marked with a steel stake and flagging. Its about 3ft from the edge of the road. Clearly off of our 15ft ROW. This guy has been a jerk since day one. He's unemployed pretty often and has nothing better to do than stir things up. He would not sign a ROW agreement for our power lines to cross about 5 feet of his property because "it would lower his property value". Apparently the 300 ft of lines crossing the middle of his property raise the value". No problem, power company just moves the lines to the other side of the road. He's confronted my father in law just about every time he mows the edges of the road to increase visiblity and make the haying easier for the neighbors. He stood in pouring rain for 2 solid hours watching me spread gravel with the bobcat just to make sure I didn't do anything to his property corner. He spotlighted some friends late at night as they drove out of our property after haying all day. He put up a hand written "speed limit" sign on a power pole along the road. "10mph slow children playing" We get a good laugh from that one. But probably the best part is that he swears his property corner crosses our road. So he should have been in on the ROW agreement and settlement. The whole $100 divided by 14 family members. His plat at the courthouse shows that his property does not cross the road. He professes that the survey and plat are incorrect. At the time of the survey he actually was employed, as a helper to the surveyor who conducted his property survey. /forums/images/graemlins/shocked.gif Sometimes you just have to shake you head and wonder how people like this live so long.
